TOWN BOARD Meeting Notes

Marion Municipal Building

Monday July 10, 2023

 

A Town Board meeting of the Town of Marion, Wayne County, NY was held on  Monday July 10, 2023 at the Marion Municipal Room.

Supervisor Bender called the meeting to order at 6:30 pm with a roll call done by Kimberly Williams, Deputy Clerk of the Board.

Supervisor Bender asked everyone to stand and give the Pledge of Allegiance.

Supervisor Bender read the following statement.

If you are attending a Town Board Meeting and have not signed up for Public Participation Section of the Town Board Meeting pursuant to the rules which have been established (24 hours prior to start of meeting), then you will not be able to express your opinion. As a courtesy to those who attend the Board Meeting, you are requested not to interrupt the meeting, and refrain from conversation that would interfere with those attending being able to hear the Board transact its business. If in fact someone interferes with the meeting or the conversation with other spectators should require a warning and it is ignored, the person could be charged with Disorderly Conduct. For public hearings, speaking will be limited to topics on the agenda.

If after the Town Board has finished their business, each person in attendance who wishes to speak will be given 3 minutes at the end of the meeting to speak on only topics discussed at the evenings meeting.

Citizens Comments:  None

Town Business: 

Councilman Lonneville stated that the exterior paint at the Marion Museum has been completed. The Town is waiting on bids from Highway Superintendent, Tim Boerman, for the sealing of the Highway Department parking lot and the walking path at the Town Park. High Expectations Contractors will be installing new windows at the Town Hall. The windows will take 2-3 weeks to arrive.

The Wayne County Sheriff’s Department has given the Town permission to use their former office upstairs in the Town Hall. This space needs work and the presence of lead paint will need to be addressed. Councilman Cramer will determine the scope of the project and will make an itemized list of what needs to be done to renovate this room. The Code Enforcement office will consider moving over to this area once renovated. Other discussions involved an elevator for the Town Hall as well as future use for the upstairs area that the Code Enforcement Department is currently using. This space may work well for the cemetery records once the Town will take over the Marion Cemetery in 2024.

Highway Superintendent, Tim Boerman and town resident Steve Williams gave an update on the Franklin Road sink hole that occurred on July 5th. The thirty-year-old metal culvert pipe had deteriorated and partially collapsed. To expediate the replacement of the pipe, Steve Williams volunteered to pick up the new four-foot diameter plastic culvert from Hudson Pipe in Penn Yan, NY. The new pipe is to be installed Tuesday July 11th by the Marion Highway Department and Larry Graf Excavating. Councilman Bliek asked Highway Superintendent Tim Boerman to make a list of other culvert pipes in the Town of Marion that may need attention soon.

Supervisor Bender read a statement from Town Clerk, Heidi Levan giving thanks to certain individuals:

Thank you to Councilman Cramer for helping the Town Hall transport old documents to the shredding truck on Friday June 30th and to the Highway Department for allowing us to use their Industrial dolly. Thank you to Steve Williams for putting out cones on Franklin Road on Wednesday, July 5th after the Town Clerk’s office received a phone call stating there was a sink hole. We also want to thank Heath Smith and Mark Vanderbrook from the Marion Highway Department for addressing this issue both on Wednesday and Thursday. Thank you to Jeff Cragg for installing the new brochure rack outside of the Town Clerk’s office.

 

Committee Reports:            

Supervisor Bender:  Assessor, Zoning, Planning

The Planning Board had no meetings and no new business. The Zoning Board met on June 27th and did not make a decision on the bakery/farm market/restaurant permit for 4750 East Williamson Road. The Hearing is tabled until the July 25th meeting. Assessor Dawn VanPatten has been working on final values. She is on vacation this week.

Councilman Bliek: Deputy Supervisor, Highway, Drainage, Water, Sewer

The Highway Department has been cutting road shoulders, hauling stone for Eddy Ridge Road, and cutting trees on Union Street. The Town parking lot next to the school will be sealed on July 11th.

Councilman Lonneville:  Historian, Public Safety

Volunteer Ken Adriaansen has been working on the interior trim at Jennie’s House. Councilman Lonneville mentioned to Highway Superintendent, Tim Boerman, that the 2×4’s can go to the Highway department to be stored and museum flooring can go to Jennie’s house located in the large room on the second floor of the Town Hall can be removed and taken to Jennie’s House.

 Councilwoman Herman: Parks, Recreation, Town Clerk, Library

Recreation Summer Soccer starts this week and will continue through August 10th. Soccer games are on Tuesday and Thursday evenings at the Town Park. Nadine Seppeler has started working at the Town Clerk’s office as the 2nd Deputy Clerk. The Marion Library is partnering with the Wayne County Fair committee to encourage summer reading. Kids will receive a free pass to the fair when they report ten hours of reading. The carpet strips have been installed in the two closets in the Library Community Room. The Marion Library is still waiting on reimbursement from the insurance company for damage caused by the burst water pipe in February.

 Councilman Cramer:  Drainage, Judicial, Cemetery, Code Enforcement

The drainage work at the Town Park is complete and walkers of the path are reporting a wonderful job. Councilman Cramer stated the Board is aware of individuals turning the cameras at the Town Park and kids messing around on the roof of the baseball dugouts. Supervisor Bender asked about setting up a time soon to discuss the transfer of the Marion Cemetery from the Cemetery Association to the Town of Marion. Councilwoman Herman said the Letter of Conveyance is being worked on. She is waiting to hear back from the NYS Division of Cemeteries representative about the rules associated with future funds transfer to the Town from the Cemetery Association.

BE IT RESOLVED, that the Marion Town Board authorizes Timothy A. Boerman, Highway Superintendent, to attend the 94th Annual New York State Association of Superintendents of Highways Conference to be conducted at the Turning Stone Resort & Casino in Verona, New York, on Tuesday, September 26, 2023 through Friday, September 29, 2023, and

BE IT RESOLVED, that expenses incurred for registration, travel, lodging, and meals be paid by the Town of Marion from Account 50104.01.000.016 at a cost not to exceed budgeted amount, and

BE IT RESOLVED, that the Town Board directs the Clerk of the Board to give a passed copy of this resolution to Timothy A. Boerman, Highway Superintendent, and the Account Clerk.

 The Board went into executive session to discuss the employment history of a particular person on a motion by Councilwoman Herman and seconded by Supervisor Bender at 7:15 pm.

With no further business, on a motion by Councilwoman Herman and seconded by Councilman Lonneville, Supervisor Bender closed the meeting at 7:40 pm.
