TOWN BOARD Meeting Notes

Monday, March 27, 2023

A Town Board meeting of the Town of Marion, Wayne County, NY was held on  Monday, March 27, 2023 at the Marion Municipal Room.

Supervisor Bender called the meeting to order at 6:30 pm with a roll call done by Heidi Levan, Clerk of the Board.

Supervisor Bender asked everyone to stand and give the Pledge of Allegiance.

Supervisor Bender read the following statement:

If you are attending a Town Board Meeting have not signed up for Public Participation Section of the Town Board Meeting pursuant to the rules which have been established (24 hours prior to start of meeting), then you will not be able to express your opinion. As a courtesy to those who attend the Board Meeting, you are requested not to interrupt the meeting, and refrain from conversation that would interfere with those attending being able to hear the Board transact its business. If in fact someone interferes with the meeting or the conversation with other spectators should require a warning and it is ignored, the person could be charged with Disorderly Conduct. For public hearings, speaking will be limited to topics on the agenda.

If after the Town Board has finished their business, each person in attendance who wishes to speak will be given 3 minutes at the end of the meeting to speak on only topics discussed at the evenings meeting.

Town Business:

Councilman Lonneville gave a recap on the American Rescue Plan Act (ARPA) funds.  4 new replacement windows are being installed this week at the Marion Museum (Jennie’s House).  The Town Hall main hallway will soon be completed.  Councilman Lonneville stated he has spoken with Tim Wheeler and as soon as the weather permits, the stucco refinishing will be done.

Supervisor Bender stated that the upstairs at the Town Hall are an embarrassment and needs to be updated.  Councilman Lonneville stated that once the museum is completed, things can move over to the museum and the upstairs can be renovated.

Discussion:

Councilman Lonneville talked about Town Projects and stated that bids are starting to come in for renovation to the kitchen at the Town Park.  The projects at the library are being completed after the water pipe froze and burst inside this winter.

A discussion took place regarding the Highway Department and the need for a new staff member.  The Town Board is considering a staff member to do maintenance during the summer and a plow roads in the winter.  Supervisor Bender will speak to the Highway Union Representative regarding this idea.

Supervisor Bender asked Zoning Board member, John Lonneville if any decisions have been made regarding a new cannabis law.  Mr. Lonneville recommended that Supervisor Bender speak to Zoning Board Chairman, Greg Bell for more information.

Historian Caryn Devlin spoke next.  Ms. Devlin would like to purchase a new laptop.  The laptop she is currently using has a few different problems.  After Ms. Devlin consulted with a computer repair service, it was recommended that a new laptop be purchased.  Town Clerk Heidi Levan will look into a new laptop for Ms. Devlin.  The Town Board discussed where the funds would come from for this purchase, ARPA funds were suggested.  Ms. Devlin also stated that an intern from SUNY Geneseo will volunteer 150 hours this summer at the museum to help get things organized.

The Town Board continued to discuss the Town of Marion Employee handbook.  They will continue this discussion at the 2nd Monday Board meeting each month.  Once they have completed their suggested changes, the Town Attorney will look over all proposed changes before a resolution is presented.

Councilwoman Herman spoke next regarding different recreation programs.  Councilwoman Herman stated the Soccer Coordinator position will be filled tonight with a resolution.  This position will be held by Sarah Griffin.  Ashley Tack will be assisting Sarah to help her get started with this position.  Ms. Tack will be volunteering for this position.

Councilman Cramer stated the next Drainage committee meeting will be held on Monday, April 17th at the Municipal Room. Town Clerk Heidi Levan will be taking notes for this meeting.  All meeting are open to the public.

BE IT RESOLVED, that the Marion Town Board received a request from the American Legion to close the roads for a Memorial Day Parade; and

NOW BE IT RESOLVED, that the Marion Town Board authorizes the closure of Mill Street at the Firehall, South Main at Mill Street, North Main Street to Cemetery Drive on May 29, 2023 from 10:30 am to 12:30 pm;

AND BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the American Legion and the Principal Account Clerk.

Resolution #311-23 Authorize Public Hearing for Appropriation from Town Hall Reserve

 WHEREAS, Toshiba has informed the town that the copier in the Town Clerks Office is older than 10 years and Toshiba can no longer guarantee service on this machine; and

BE IT RESOLVED, that the Marion Town Board authorizes the Town Clerk to purchase a copier for the Town Hall to replace Toshiba copier currently in place in the Town Clerks office, and;

BE IT RESOLVED, that expenses incurred for such copier be expensed from ARPA funds account 16704.38.000.053 not to exceed $4895 and;

BE IT RESOLVED, that the Town Board directs the Clerk of the Board to give a copy of this resolution to the Town Clerk and the Principal Account Clerk

Resolution #316-23 Award Contract to Carpet Spectrum to Replace the Carpet Base Molding at the Library Which was Damaged by a Burst Water Pipe

WHEREAS, the Town of Marion Library sustained water damage from a burst pipe; and

WHEREAS, the Town of Marion received 1 bid; and

BE IT RESOLVED, that the Marion Town Board awards the contract to Carpet Spectrum to replace the carpet base molding in the Community Room and in the storage room to be paid by NYMIR insurance not to exceed $584.16; and.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Tracy Whitney and the Principal Account Clerk.

Resolution #317-23 Award Contract to Carpet Spectrum to Install Carpet in the Hallway and Stairs at the Town Hall

WHEREAS, the Town of Marion held a public hearing for the appropriation of Town Hall reserve funds to make improvements/repairs to the Marion Town Hall; and

WHEREAS, requested two bids; and

WHEREAS, the Town of Marion received 1 bid; and

BE IT RESOLVED, that the Marion Town Board awards the contract to Carpet Spectrum, to install carpet in the hallway and the stairs at the Town Hall to be transferred from Town Hall reserve and expensed from account 16204.01.000.050 with an amount not to exceed $2,141; and.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Carpet Spectrum and the Principal Account Clerk.

Resolution #318-23 Accept Resignation of Michael Lane Planning Board Member

WHEREAS, Michael Lane has submitted his resignation as the Planning Board Member effective immediately; now

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Fred Walker, Adrienne Compton and the Principal Account Clerk.

Resolution #319-23 Audit Justice Books 2022

WHEREAS, Court Clerk, Theresa Ryan presented 2022 Justice Books; and

BE IT RESOLVED, the Town Board audited such books; and

BE IT FURTHER RESOLVED directs the Clerk of the Board to give a copy of this resolution to Theresa Ryan and the Principal Account Clerk

Additional Citizen Comments –   None

On a motion from Supervisor Bender and seconded by Councilman Bliek, the Town Board moved into executive session at 7:02pm to discuss employment history of a particular person.

 On a motion from Councilwoman Herman and seconded by Councilman Lonneville, the executive session was closed at 7:48pm.

With no further business, on a motion by Councilwoman Herman and seconded by Councilman Lonneville, Supervisor Bender closed the meeting at 8:27pm.
