TOWN BOARD Meeting Notes

Marion Municipal Building

Monday April 10, 2023

A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday April 10, 2023 at the Marion Municipal Room.

Supervisor Bender called the meeting to order at 6:30 pm with a roll call done by Kimberly Williams, Deputy Clerk of the Board.

Supervisor Bender asked everyone to stand and give the Pledge of Allegiance.

Supervisor Bender read the following statement.

If you are attending a Town Board Meeting and have not signed up for Public Participation Section of the Town Board Meeting pursuant to the rules which have been established (24 hours prior to start of meeting), then you will not be able to express your opinion. As a courtesy to those who attend the Board Meeting, you are requested not to interrupt the meeting, and refrain from conversation that would interfere with those attending being able to hear the Board transact its business. If in fact someone interferes with the meeting or the conversation with other spectators should require a warning and it is ignored, the person could be charged with Disorderly Conduct. For public hearings, speaking will be limited to topics on the agenda.

If after the Town Board has finished their business, each person in attendance who wishes to speak will be given 3 minutes at the end of the meeting to speak on only topics discussed at the evenings meeting.

Citizens Comments:  None

Town Business: 

Councilman Lonneville gave an update on ARPA Funds and current Town Projects. At the Marion Museum (Jennie’s House), three windows have been installed. J&L Home Improvement will attach the needed outdoor siding and drywall was installed by volunteer Pete Callahan.

At the Town Hall, the Assessor shelf and window should be installed this week. Hallway bulletin boards will be hung back up. The Carpet Spectrum will install new carpet in the hallway and the stairs within the next three weeks. Stucco repair on the Town Hall exterior is scheduled for next week. The Marion Town Board is happy to award the bid for a new furnace at the Town Hall to J. Cornell Heating. The new system will combine the first and second floors for heating and cooling. At the Town Park, the entry roof is complete above the entrance to the outside restroom. RFPs (Request for Proposal) have been sent out for a kitchen remodel. They are due back April 27th, and the project is estimated to be completed by July 25th.

Supervisor Bender and Councilman Lonneville will meet with the Town Attorney on Tuesday April 11, 2023 to discuss the Nutrien Ag Solutions property lease.

Discussion:

Town resident Justin Krocke spoke to the Board about plans for his property on Union Street. Justin is the new owner of the former First Reformed Church/Kids Time building. Justin would like eventually to fully restore the building. This will take many years and Justin is working on a five-year plan. His first projects involve replacing the roof, excavating the parking lot, and adding crushed stone. He would like the whole community to benefit from this property. Plans include a fun center with an arcade in the basement for kids. Since the main hall will take several years to complete, Justin would like to start by offering the community an outside event. He would like to have live music after the Fall Festival in September. This would be a ticketed event and a portion of sales would be given back to the Town of Marion as a donation. The event would be from 5:00 pm – 9:00 pm. The Town Board was positive towards Justin’s plans and would like to hear more information at another meeting. Supervisor Bender asked about how neighbors on Union Street felt about this and Councilman Lonneville asked about parking. Justin will obtain signatures from neighbors showing their approval of this event and speak to the school and Diamonds Seven about parking. He will also look into food vendors and the requirements to have alcohol at this event. Justin will submit a formal proposal at the May 8th Town Board meeting.

Committee Reports:                   

Supervisor Bender:  Assessor, Zoning, Planning

Supervisor Bender stated the Assessor’s office is starting the steps necessary to begin a tax re-valuation. Dawn VanPatten will speak to the Town Board soon to discuss the timeline further.

The Zoning Board of Appeals provided a thorough packet about Cannabinoid Hemp to the Town Board. The dog kennel has been approved for the corner of Ridge Chapel Road and Cory Corners Road by the Zoning Board.

Councilman Bliek: Deputy Supervisor, Highway, Drainage, Water, Sewer

Work has begun on the new Sewer Plant Pump Station. Pipes can be seen along Newark Marion Road. Highway Superintendent, Tim Boerman reported that trucks were out ten times to plow. The Highway Department has also been ditching, picking up tree limbs and painting historical markers. Street sweeping has begun.

Councilman Lonneville:  Historian, Public Safety

The Wayne County Bicentennial celebration kicks off tomorrow (Tuesday April 11th) with many events in Lyons, NY. Bells will be rung at each Town throughout the County at 10:58 am. Councilman Lonneville stated that Code Enforcement Officer Daren Arrington has been checking on several properties in Town that are causing a safety concern.

 Councilwoman Herman: Parks, Recreation, Town Clerk, Library

Councilwoman Herman was absent; however, reports were given by Councilman Lonneville and Councilman Cramer. Councilman Lonneville stated that six new benches and 6 new garbage cans have been made for the Town Park. Councilman Cramer reported that security cameras at the park took a power hit from a storm and needed a re-boot. Bids have been requested for grinding out tree stumps at the Town Park. Topsoil needs to be placed in the low spots and seeded down.

Councilman Cramer:  Drainage, Judicial, Cemetery, Code Enforcement

Councilman Cramer announced that the next Drainage meeting is Monday April 17, 2023 at 7:00 pm in the Marion Municipal Room. The Cemetery Association meeting is Tuesday April 18, 2023 at 7:00 pm at Stevens Funeral Home. Councilman Cramer reached out to the Association of Towns for information and documents about auditing procedures. He felt that since we already pay membership dues, there should be more information available without additional fees. The Town will also keep working closely with the New York State Comptroller’s office. The Town Court has been busy. All financial reporting looks good. The Code Enforcement office continues to look more into the abandoned properties in the Town of Marion. Over the last couple of months there has been an increase in the number of new generator permits issued.

BE IT FURTHER RESOLVED that the Public Hearing will be set for Monday, May 22, 2023 at 6:30pm at the Marion Town Board meeting room; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

Resolution #406-23 Award bid to J. Cornell Heating to Replace the Furnaces at the Town Hall

The following resolution was adopted

WHEREAS, the Town of Marion sent out an RFP for the replacement of the furnaces at the Town Hall; and

WHEREAS, the Town of Marion received 2 estimates and one declination; and

BE IT RESOLVED, that the Marion Town Board awards the bid for the replacement of the furnaces at the Town Hall to J. Cornell Heating with an amount not to exceed $14,045.00 to be expensed out of 16204.01.000.042; and

BE IT FURTHER RESOLVED, the Town of Marion directs the Clerk of the Board to give a copy of this resolution to J. Cornell Heating and the Principal Account Clerk.
