TOWN BOARD Meeting Minutes

Marion Municipal Building

Monday, May 8, 2023

A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday, May 8, 2023 at the Marion Municipal Room.

Supervisor Bender called the meeting to order at 6:30 pm with a roll call done by Heidi Levan, Clerk of the Board.

Supervisor Bender asked everyone to stand and give the Pledge of Allegiance.

Supervisor Bender read the following statement:

If you are attending a Town Board Meeting and have not signed up for Public Participation Section of the Town Board Meeting pursuant to the rules which have been established (24 hours prior to start of meeting), then you will not be able to express your opinion. As a courtesy to those who attend the Board Meeting, you are requested not to interrupt the meeting, and refrain from conversation that would interfere with those attending being able to hear the Board transact its business. If in fact someone interferes with the meeting or the conversation with other spectators should require a warning and it is ignored, the person could be charged with Disorderly Conduct. For public hearings, speaking will be limited to topics on the agenda.

If after the Town Board has finished their business, each person in attendance who wishes to speak will be given 3 minutes at the end of the meeting to speak on only topics discussed at the evenings meeting.

Town Business: 

Councilman Lonneville thanked Town Clerk, Heidi Levan for helping to deliver the May community calendars.

Councilman Lonneville stated the Marion Town Attorney is writing up a contract for Nutrien to review and consider for the Town of Marion to be able to use a piece of land by the Town Park.

Councilman Lonneville next stated that there is a resolution being presented at this evening’s meeting to paint the main section of the Town Museum.  A long discussion took place in regard to this resolution.  Historian Caryn Devlin suggested that the Town start a building reserve fund for the museum.

Councilman Lonneville spoke next in regard to the Town Hall project.  Touch up painting and carpet are still needed at the Town Hall.  Councilman Cramer suggested Dutch doors for the Assessors office and the large meeting room and will look into this further.  Councilman Lonneville also stated that a new furnace will be installed at the Town Hall in June of this year.

Councilwoman Herman spoke next regarding the public restroom at the Town Park that is accessible from the outside.  Councilwoman Herman would like to see the restroom open each morning and closed each evening.  Resident, Samantha Starks will put in a bid to open and close the restrooms.  Councilman Cramer will look into getting quotes to install auto/timed locking doors.

Councilman Lonneville thanked John Lonneville, Marcia Lonneville and Heidi Levan for helping him clean out the main pavilion and kitchen at the Town Park and get it ready for the first rental of the season.

Councilman Herman stated she had a resident who contacted her in regard to a tree and fence that was removed during the sidewalk project on North Main Street that needs to be repaired.  Highway Superintendent, Tim Boeman was aware of the problems and will get the problems resolved quickly.

Supervisor Bender:  Assessor, Zoning, Planning

Supervisor Bender stated the Zoning Board has  requested a public hearing to be held on Monday, May 22nd at 6:30pm in regard to the cannabis law.  Supervisor Bender also stated that Assessment Grievance day will be held on Thursday, May 25th from 4-8pm.

Councilman Bliek: Deputy Supervisor, Highway, Drainage, Water, Sewer

Councilman Bliek stated Chief Sewer Operator, Jeff Cragg is currently unavailable.  Any questions can be sent to the Wayne County Water and Sewer Authority, as they are covering for Jeff while he is out.  Councilman Bliek next asked Highway Superintendent, Tim Boerman to give an update on the Highway Department.  Mr. Boerman stated the Highway Department has been busy cleaning and repairing any damage due to plowing over the winter.  They have also rolled and prepared the baseball/softball fields.  Thank you to Councilman Bliek for spreading the mulch at the Town Park.  Mr. Boerman also thanked Councilman Bliek for mowing at the library, museum and empty lot beside the old M&T bank.  Mr. Boerman also stated that Eddy Ridge Road will be resurfaced in the near future.

Councilman Lonneville:  Historian, Public Safety

Councilman Lonneville thanked Marion Highway Department for installing the railroad tracks, formally at the Town Park, at Jennie’s House (Town Museum).   Councilman Lonneville also thanked the Highway Department for installing the new William G. Pomeroy Foundation Historic marker at the Upper Corners Cemetery that honors the revolutionary soldier graves.  Councilman Lonneville thanked Dana Luckman for donating mulch that was used at both the museum and town park.  Historian, Caryn Devlin thanked the Marion Fire Department for directing traffic during the unveiling of the historic marker at the Upper Corners Cemetery and the Marion American Legion color guard for their presentation as well.  Ms. Devlin also thanked the Marion 4H Club Bucks & Does for spreading mulch at the museum.

Councilwoman Herman: Parks, Recreation, Town Clerk, Library

Councilwoman Herman asked that a quote be given to have an AED device purchased and kept at the Town Park.  Clerk to the Board, Heidi Levan will work on obtaining that information.  Councilwoman Herman stated that T-ball has started.  There have been a few problems with parents being inappropriate.  If this continues to happen, the Night Supervisor and/or Baseball coordinator will call 911.  The baseball/softball program now has a heavy-duty cart that can be used to transport equipment from the storage barn to the fields.  Thank you to Chief Sewer Operator, Jeff Cragg, for assembling the cart.  Councilwoman Herman stated the Marion Cemetery Association will be meeting with the NYS representatives to see what steps are needed to dissolve the Association.

 Councilman Cramer:  Drainage, Judicial, Cemetery, Code Enforcement

Councilman Cramer asked if we could get a quote from the Finger Lakes Security System to have cameras installed on the outside of the Municipal room and Town Hall.  Clerk to the Board, Heidi Levan will contact FLSS to get a quote. Councilman Cramer also stated that the courts have been busy.  Councilman Cramer has asked Code Enforcement Officer, Daren Arrington to add a section to this monthly report to address public safety issues.  Councilman Cramer stated the Drainage committee recently met and Councilman Cramer will work with temporary Drainage Clerk, Heidi Levan to get RFP’s sent out for work that needs to be done on the corner of Goosen Rd and Cory Corner’s Rd.

Resolution #503-23 Resolution to Authorize Highway Superintendent to Attend 2023 School for Highway Superintendents

The following resolution was adopted

WHEREAS, the 78th Annual School for Highway Superintendents will be conducted at Ithaca College in Ithaca, New York on June 5-7, 2023.

THEREFORE BE IT RESOLVED, that the Marion Town Board authorizes Timothy Boerman, Town of Marion Highway Superintendent, to attend above mentioned School for Highway Superintendents, and

THEREFORE BE IT FURTHER RESOLVED, that the expenses incurred for registration, travel, lodging and meals will be paid by the Town of Marion and be appropriated from Account #50104.01.000.016 at a cost not to exceed the budgeted amount.

AND BE IT FURTHER RESOLVED, that the Town Board directs the Clerk of the Board to give a passed copy of this resolution to Timothy Boerman, Highway Superintendent and the Principal Account Clerk.

Resolution #504-23 Authorize Advertising for Position on Planning Board

The following resolution was adopted

BE IT RESOLVED, that the Marion Town Board authorizes the Clerk of the Board to advertise in the legal newspaper for the Town of Marion for applicants to fill a vacant position on the Planning Board.

The Town of Marion is accepting applications for the position of Planning Board member.  Applications may be picked up at the Marion Town Clerk’s Office and returned by June 15, 2023 at 4:00 p.m.

Resolution #505-23 Authorize Purchase of Laptop Computer for Historian

 On a motion by Councilman Cramer and seconded by Councilman Bliek

The following resolution was adopted

 WHEREAS, the Historian is in need of a new computer; and

 BE IT RESOLVED, that the Marion Town Board authorizes the purchase of a Dell laptop from State Bid; and

 BE IT RESOLVED, that the Marion Town Board authorizes the use of ARPA funds for this expense amount not to exceed $1065.83; and

 BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Historian and the Principal Account Clerk.

Resolution #506-23 Authorize the Town of Marion to Send out an RFP to have the Front of the Marion Town Court Painted Prior to Installing New Awnings – 3827 North Main Street

 On a Motion from Councilman Lonneville and seconded by Councilman Cramer –  This resolution was tabled.

WHEREAS, the front of the Marion Town Court is in need of being painted due to rotted and deteriorated wood;

BE IT RESOLVED, that the Marion Town Board authorizes an RFP to be sent;

BE IT FURTHER RESOLVED directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk

Resolution #507-23 Award Contract to Mark Neal Painting to Wash and Paint all Vinyl Siding and Trim at the Museum – Jenny’s House

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Mark Neal Painting and the Principal Account Clerk.

BE IT RESOLVED, that the Marion Town Board awards the contract to J. Cornell Heating to remove the old furnace and install a new furnace and A/C unit at the pavilion at the Town Park with an amount not to exceed $6,800 to be expensed from park reserve funds for work to begin October 2023; and.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to J. Cornell Heating and the Principal Account Clerk.
