TOWN BOARD Meeting Minutes

Marion Municipal Room

Monday, October 30, 2023

A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday, October 30, 2023 at the Marion Municipal Room.

Supervisor Bender called the meeting to order at 6:30pm and asked the Clerk of the Board to give a roll call.

ABSENT:

OTHERS IN ATTENDANCE:  Marcia Lonneville; Susan Potter-Tuma; Jeff Tuma; Priscilla Flack; Jamie Corteville; Kerry Sargent; Christine Stanford.

Supervisor Bender asked everyone to stand and give the Pledge of Allegiance.

Public Hearing:

  1. 6:30 – Budget

The Public hearing opened at 6:33pm with the Clerk of the Board reading the legal notice that was published in the Times of Wayne County newspaper. Supervisor Bender started by saying the budget was up .22 cents per $1,000 which is an increase of 4.02%.  This is mostly due to the Town of Marion taking over the Marion Cemetery starting in January 2024.  Supervisor Bender stated the Town of Marion didn’t have a choice regarding taking over the cemetery.  Councilwoman Herman stated, the Town did have a choice.  The choice was to have a conveyance or an abandonment.  The Town choose to have a conveyance and funds would become available in January 2024.  Residents in the room did have questions regarding the budget.  They included:

Why was there no increase for planning and zoning board members?

Why were funds removed from the recreation lines?

Why was the Assessor salary decreased by 6%?

Will a re-evaluation take place soon because the towns equivalization rate is at 71%?

Why was the crossing guard salary decreased?

Why was the salary for the deputy court clerk removed?

Why is the Code Enforcement Officer salary increased by 12%?

Under the summer recreation equipment line – why is the line increased for 2023 but not for 2024?

Why is the revenue for sales tax not recorded?

Can the 2022 fiscal year numbers be included in the budget?

All questions were answered by the Town Board members. Supervisor Bender asked 3 times if anyone else had questions on the budget. With no further questions, the public hearing was closed at 6:50pm on a motion from Councilman Lonneville and seconded by Councilwoman Herman and approved with all ayes in the room.

  1. 6:30 – Inserts in Tax Bills

The Public hearing opened at 6:53pm with the Clerk of the Board reading the legal notice that was published in the Times of Wayne County newspaper.  Town Clerk, Heidi Levan explained what this new local law is.  Supervisor Bender asked 3 times if anyone in the room had questions or concerns and with no questions, the public hearing was closed at 6:58pm on a motion from Councilwoman Herman and seconded by Councilman Lonneville.

Discussion:

The Town Board discussed new cemetery rules and regulations that will go into place on January 1, 2024.

Councilwoman Herman thanked Town Clerk, Heidi Levan for putting a community recreation committee together.  The first meeting was held October 24, 2023 and a second meeting is scheduled for Tuesday, November 21, 2023 at 6pm.

Citizens Comments:

Kerry Sargent (Library Board member) shared with the Town Board that the heating system at the library was in need of repair and quotes are being obtained.

The following resolution was adopted

WHEREAS, the Marion Town Board has received the 2024 Tentative Budget for the Town of Marion; and

WHEREAS, the Marion Town Board prepared the 2024 Preliminary Budget for the Town of Marion; and

WHEREAS, a Public Hearing on the 2024 Budget was held on October 30, 2023; now

BE IT RESOLVED, that the Marion Town Board adopts the 2024 budget as attached; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to

the Principal Account Clerk.

Resolution #1028-23 Adopt Local Law #7-2023 – Permit Materials to Be Enclosed with Real Property Tax Bills

The following resolution was adopted

 WHEREAS, the Marion Town Board held a public hearing on October 30, 2023; and

WHEREAS, The State of New York Tax Law, section 1826, requires that any insert such as a circular, pamphlet, card, hand bill, printed or written notice of any kind; be authorized or required by law to be included with the tax bill. At times the Town Board of the Town of Marion sees benefit to including notices with the tax bills that are sent out to all the owners of real property in the Town. To permit the use of such inserted notices, and

BE IT RESOLVED, Town Board hereby adopts the Local Law #7-2023; and

BE IT ENACTED by the Town Board of the Town of Marion, Wayne County, State of New
York, as follows:
Section One: This Local Law is adopted pursuant to the provisions of the New York
Municipal Home Rule Law.
Section Two: The Town Board of the Town of Marion elects to adopt this Local Law to
permit the placement of enclosure notices with tax bills in the Town of Marion. This includes a
legend printed on the tax bill or a separate document, insert, flyer, notice, circular, handbill,
card, pamphlet, or other information to be included with the tax bill. The term tax bill shall
include the State County and Town Tax Bill as well as the School Tax Bill for properties within
the Town of Marion. The Town Board of the Town of Marion, by resolution adopted by the
Town Board, may direct that such notice be included with the tax bill in such form and manner
as it may decide.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

Resolution #1029-23 Set Public Hearing Local Law #8-2023 – Enact Cemetery Regulations

On a motion by Councilwoman Herman and seconded by Councilman Lonneville

The following resolution was adopted

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to advertise the following in the legal newspaper for the Town of Marion:

WHEREAS, the Marion Town Board needs to enact Cemetery Regulations; and

BE IT RESOLVED, Town Board hereby sets a public hearing to be held on November 13, 2023 @ 6:30 regarding Local Law #8-2023 Enacting Cemetery Regulations; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

Resolution #1030-23 Set Public Hearing Local Law #9-2023 – Cold War Exemptions

 BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to advertise the following in the legal newspaper for the Town of Marion:

WHEREAS, the Marion Town Board needs to add Cold War Exemptions; and

BE IT RESOLVED, Town Board hereby sets a public hearing to be held on November 13, 2023 @ 6:30 regarding Local Law #9-2023 Cold War Exemptions; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

Resolution #1031-23 Amend Resolution #1001-23 Award Contract to High Expectations Construction and Landscaping to Repair Siding on the Back of the Court Building

On a motion by Councilman Lonneville and seconded by Councilman Bliek

ADOPTED:  Ayes:  5 Bender, Lonneville, Herman, Cramer, Bliek

The following resolution was adopted

WHEREAS, the Town of Marion sent out an RFP to repair siding on the back of the Marion Court Building; and

WHEREAS, the Town of Marion received 1 bid; and

WHEREAS, the Marion Town Board awarded the contract to High Expectations Construction and Landscaping with an amount not to exceed $17,122.99 to be expensed out of 16204.01.000.050 – Building Renovations; and

WHEREAS, additional repairs due to the weather elements needed to be completed; and

BE IT RESOLVED, the Town of Marion approves the change order for an additional $1,785.00 to be expensed out of 16204.01.000.050 – Building Renovations with an amount for the project not to exceed $18,907.99; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to High Expectations Construction and Landscaping and the Principal Account Clerk.

With no further business, on a motion by Councilman Cramer and seconded by Councilwoman Herman, Supervisor Bender closed the meeting at 7:06pm.
