TOWN BOARD ORGANIZATIONAL MEETING MINUTES

Tuesday, January 2, 2024

A Town Board meeting of the Town of Marion, Wayne County, NY was held on Tuesday, January 2, 2024 at 6:30pm in the Marion Court Room.

Supervisor Johnson called the meeting to order at 6:30pm and asked the Clerk of the Board to give a roll call.

Supervisor Johnson opened the meeting by asking Town Clerk, Heidi Levan to swear in the new officers for the Town of Marion.  Summer Johnson was sworn in as Town Supervisor.  Margi Taber was sworn in as Town Councilwoman.

Supervisor Johnson asked everyone to stand and give the Pledge of Allegiance.

Supervisor Johnson next read the following statement:

To my board, support staff, family and community members:

Not long ago, I was introduced to the small farm town named Marion. From the

beginning I could sense a great deal of enthusiasm for its history, operations, and

culture. I knew that this was the place where I would start to fulfill my lifelong pursuit of

public service. I do not take this role lightly. Those who know me will tell you I am a

serious person, oftentimes “too serious”. I’m honored that the people of Marion have

trusted me to project, promote and serve the town’s best interest.

I promise to uphold the values and principles of our community and act with care when

faced with a difficult decision. I will rely on this board to do their due diligence in

providing the most accurate representation of their committees and allow for open and

respectful discussions.

Thank you to my supporters, my family (some of whom are here tonight) and my

husband, without his encouragement and love this would not have been possible.

I’m excited to leave my mark on Marion and leave it better than how I found it.

Notice is hereby given that the Marion Town Board will be having a public hearing to amend the Town of Marion Fee Schedule for 2024.

The Public Hearing will be held during the Town of Marion Organizational meeting being held Tuesday, January 2, 2024 at the Marion Municipal Room 3827 North Main Street, Marion, NY 14505 at 6:30pm.

Anyone for or against will be given an opportunity to speak on this date.

Town Clerk Heidi Levan stated that the fee schedule for the Town of Marion was adding fees for cemeteries, adjustment on sheds and 2nd mailing fee for town and county taxes.  After asking three times if anyone in attendance had any questions, concerns or comments and no one commenting, the public hearing was closed at 6:36pm on a motion from Councilwoman Herman and seconded by Councilman Cramer.

  1. Swearing in of Officers

Took place at the beginning of the meeting.

  1. Rules of Order for 2024

Supervisor Johnson would like the Town Board to enact Robert’s Rules of Order for Town Board meetings.  Councilwoman Herman asked if each board member was given a copy to review so a decision could be made.  Supervisor Johnson stated it is a 500 book and she would suggest the board look at it online or even the condensed version.

Councilman Lonneville objected to the committee assignments and asked for the Town Board to review the assignments line by line.  Supervisor Johnson did revise some of committee chair and co-chair positions.  The amended list is below.

Councilwoman Herman stated she would like to continue to be on the cemetery committee due to the fact she was the treasurer of the Marion Cemetery Association and helped convey the cemetery to the Town. Supervisor Johnson took this into consideration and added Julie as the co-chair for the cemetery committee.

Councilman Lonneville also asked when the Planning Board will be setting up a new comprehensive plan committee to review and update the Town of Marion Comprehensive plan.

Councilman Lonneville asked that the Times of Wayne County Newspaper be contacted and asked if they could publish the meeting notes for the Town of Marion as the reporter from the newspaper doesn’t always come to the meetings and when they do, wrong information is reported.  Town Clerk Heidi Levan will reach out to the owners of the paper.

Town Clerk Heidi Levan announced that the Town of Marion was awarded a grant from Wayne County Youth Bureau and the Office of Children and Family Services for $49,964 to be used for Summer Recreation.  This grant will be in collaboration with the Marion School District.  More information to come once the contract with the county has been received.

Councilman Lonneville next thanked Judy Casler for her many years as the President of the Marion Events Organization.  Judy has decided to step down.  Samantha Starks is new the President and Councilman Lonneville welcomed her to this position.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to all Town of Marion Department Heads and the Times.

 Resolution #104-24 Adopt 2024 Mileage Reimbursement Rate

WHEREAS, the Marion Town Board adopted a mileage reimbursement policy per resolution #030608; and

NOW BE IT RESOLVED, that the Marion Town Board sets the reimbursement rate @ $ .67 effective January 1, 2024; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to all Town employees and Department Heads.

Resolution #105-24 Appoint Town Attorney

BE IT RESOLVED, that David Fulvio shall be reimbursed for services performed on an as needed basis at the rate of $200.00 per hour; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Town of Marion Department Heads, and David Fulvio

 Resolution #106-24 Authorize the Town Clerk to Advertise Town Board Meetings for 2024

BE IT RESOLVED, Authorize the Town Clerk to advertise in the legal newspaper for the Town of Marion as follows:

BE IT RESOLVED, The Marion Town Board meetings for 2024 will be held on the 2nd and 4th Monday of each month except for federal holidays.  If a federal holiday falls on a Monday, the Marion Town Board will meet on Tuesday of that week.  All meetings are held in the Marion Court Room located at 3827 N. Main Street, Marion, NY  14505 and,  All meetings start at 6:30 p.m. and are open to the public.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

 Resolution #107-24 Authorize Amended Fee Schedule Local Law #1-2024

WHEREAS, the Town of Marion Board has recommended a new fee schedule for the Town of Marion; now

BE IT RESOLVED, that the Marion Town Board adopts the fee schedule with the following changes effective January 2, 2024:

  1. Storage Sheds:          Anything Greater than 145 sq. ft $60.00
  2. Cemetery:

Plots  –  $550

Single Lot (3’x8”)   Lots are 3’x8’ not 8”

Opening/closing full burial-  $650

Opening/Closing cremation – $300

Infant burials –  $300  –

Foundation work –  $1.00 per square inch with a minimum of $250 charge.

**Additional burial fee: Friday/Saturday/Sunday/Holiday                     $ 100.00

3.  Town and County Taxes – 2nd Mailing Fee – $2.00

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Code Enforcement Officer, Chief Operator WWTP, Tim Boerman, Adrienne Compton and the Town Clerk.

Resolution #108-24 Appoint John Lonneville as Member to the Marion Zoning Board of Appeals

Additional Citizen Comments:  John Lonneville stated that the Town of Marion has a dirt bike problem.  During the meeting, there was a person riding a wheelie down the center of the road.  No registration, no plate.  This is a problem that needs to be addressed.  Councilman Cramer stated this has been an ongoing problem and after dealing with the problems on Daniel Drive, the police have stated all incidents require a police report.  A video and/or pictures are not enough, someone from law enforcement must come out and take a statement.  Please call 911 whenever there is a problem.

John Cornell stated he worked in the Marion Town Hall for over 2 weeks this past fall.  He wanted to publicly thank the ladies who work in the Town Hall for being so kind to the residents even after customers can be rude.  Mr. Cornell went on to say the Marion Town Hall staff deserve a lot of credit for what they do and how professional they all are.

On a Motion from Councilman Cramer and seconded by Councilwoman Taber, the Board moved into executive session at 7:23pm to discuss matters relating to proposed, pending or current litigation.

With no further business, on a motion by Councilwoman Herman and seconded by Councilwoman Taber, Supervisor Bender closed the meeting at 7:42pm.
