A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday, August 25, 2025 in the Marion Court Room.
Supervisor Johnson called the meeting to order at 6:30 pm with a roll call done by Heidi Levan, Town Clerk/Clerk of the Board.

Councilwoman Herman read the following statement:
A Heartfelt Thank You to Western Wayne Ambulance AM20 and Marion Volunteer Fire Department
Over the weekend, my husband and our good friend were working together to put up a tree stand when things took a sudden and unfortunate turn. They suffered a hard fall, and our friend sustained a serious leg injury. The accident occurred deep in the woods behind the orchard, making access and rescue especially difficult.
We are incredibly grateful to the dedicated members of Western Wayne Ambulance AM20 and the Marion Volunteer Fire Department who responded to the call. Their teamwork, creativity, and professionalism in navigating the terrain and safely extracting our friend made all the difference. Thanks to their swift and careful efforts, he was transported out of the woods and into the care he needed.
At the time, we did not fully realize the extent of his injuries. He is now recovering and facing a long road ahead, but we are certain that the outcome could have been much worse without the outstanding work of these emergency responders.
On behalf of our families and our community, thank you. We are extremely fortunate to have such compassionate and capable individuals serving Marion and the surrounding areas.

WHEREAS, the Marion Town Board has received a request for an intersection survey for State Route 21 at Buffalo Street and Marion-Walworth Road; now
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to petition the Wayne County Highway Department and the New York State Department of Transportation to conduct a study on the above intersection to determine if a full stop light can be installed; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to send a copy of this resolution to Wayne County Highway Department, NYS Department of Transportation and Marion Highway Department.
Resolution #814-2025 Set a Public Hearing to Utilize Contingency Funds to create a new .gov website

WHEREAS, a new ‘.gov’ website is needed for the Town of Marion, an unfunded mandate from NYS; and
BE IT RESOLVED, that the Marion Town Board sets a public hearing to utilize contingency funds for this approved project for September 8, 2025 and 6:30pm; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

BE IT RESOLVED, that the Marion Town Board authorizes the Clerk of the Board to advertise in the legal newspaper for the Town of Marion as follows:
The Marion Town Board will hold a Public Hearing on September 8, 2025, @ 6:30 PM, at the Marion Court Room, 3827 North Main Street, Marion, for a proposed Local Law #1 – 2025 regarding the “Real Property Tax Levy Limit” as follows:
Local Law #1 – 2025 “Real Property Tax Levy Limit”
Section 1. Legislative Intent
It is the intent of this Local Law to override the limit on the amount of real property taxes that may be levied by the Town of Marion pursuant to General Municipal Law §3-c, and to allow the Town of Marion to adopt a budget for the fiscal year 2026 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law §3-c.
Section 2. Authority
This Local Law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes the town board to override the tax levy limit by the adoption of a local law approved by the vote of sixty percent (60%) of the town board.
Section 3. Tax Levy Limit Override
The Town Board of the Town of Marion, County of Wayne, is hereby authorized to adopt a budget for the fiscal year 2026 that requires a real property levy in excess of the amount otherwise proscribed in General Municipal Law, §3-c.
Section 4. Severability
If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application thereof to any person firm or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this Local Law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.
Section 5. Effective Date. This Local Law shall take effect immediately upon filing with the Secretary of State.

BE IT RESOLVED, that the Marion Town Board authorizes hiring Kristen Sloane for the position of recreation basketball coordinator for the 2025/26 recreation basketball program at a stipend of $1,000 per 2025 budget. Payment to be taken from budget line 73101.01.0.084; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Kristen Sloane, Councilwoman Taber and the Principal Account Clerk.

The Town of Marion is accepting applications on a rolling basis for the position of Board of Assessment Review, Applications may be picked up at the Marion Town Clerk’s Office; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Assessor, Mike Rados and the Principal Account Clerk
Resolution #818-2025 Marion Fall Festival Parking Lot Closure

BE IT RESOLVED, that the Marion Town Board hereby requests the following Municipal parking lot next to Jennies House and next to Marion Elementary School to be fully closed to all traffic on Friday, October 3, 2025 and Saturday October 4, 2025 from 7 a.m. – 10 p.m; and
BE IT FURTHER RESOLVED, that the Marion Town Board directs the Clerk of the Board to send a copy of this resolution to local businesses and Town employees.
BE IT FURTHUR RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Marion Historic Association, Marion Events Organization and Principal Account Clerk, Kathy Cauwels.

North Main Street from the South side of the Elementary School driveway to Buffalo Street
South Main Street from Buffalo Street to Mill Street
Maple Ave from Main Street to the Marion Library.
BE IT RESOLVED, that the Marion Town Board hereby request the following streets to be closed but open to local and festival traffic only on Saturday October 4, 2025 from 7 a.m. – 6 p.m.

Maple Ave at Union Street
North Main Street from Sunset Drive to Union Street
BE IT FURTHER RESOLVED, that the Marion Town Board directs the Clerk of the Board to send a copy of this resolution to E911, Marion Fire Department, Western Wayne Ambulance, Marion Fire District, Nutall Golf Cart and Storage, Marion Post Office, Wayne County Highway Department, Wayne County Sheriff, NYS Police Substation, Williamson, WCWSA, Marion School District Bus Garage, Marion Highway Department, and Marion Library.

WHEREAS, the Marion Town Board hired Watts Architects & Engineers to prepare a pre-demolition survey of the Town of Marion Sewer building resolution #608-2025; and
BE IT RESOLVED, that the Marion Town Board authorizes Watts Architects & Engineers to now create an abatement design plan; and
BE IT RESOLVED, that the Town of Marion did hold a public hearing on June 9, 2025 to spend sewer funds; and
BE IT RESOLVED, that the Marion Town Board authorizes payment for the following:
- $5,750.00 – Abatement Design Services
- $1,700.00 – Asbestos Monitoring & Air Sampling Services

Executive Session: On a motion from Councilwoman Herman and seconded by Councilman Lonneville, the Town Board entered into execution session to discuss the employment history of a town personal. The executive session opened at 7:12pm and closed at 7:33pm
The Town Board went back into regular session at 7:33pm to presented and passed the following resolution.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.
