TOWN BOARD MEETING MINUTES

Tuesday, October 14, 2025

 A Town Board meeting of the Town of Marion, Wayne County, NY was held on Tuesday, October 14, 2025 at the Marion Town Court Room.

Supervisor, Summer Johnson called the meeting to order at 6:00pm and asked the Clerk of the Board to give a roll call.

The Town Board discussed the 2026 budget from 6pm – 7pm with the following changes made to the tentative budget.  All changes were made with a motion/second and long roll vote of the Town Board members.  These changes will go into the Preliminary budget.

On a Motion from Councilman Cramer and second by Councilman Lonneville, Line Item #14101.01.0.257 – Deputy Town Clerk #2 was increased to $3,000.  The long roll vote was as follows:  Supervisor Johnson – Naye.  Councilwoman Herman – aye, Councilman Cramer – aye, Councilman Lonneville – aye, Councilwoman Taber – aye.  The motion was passed 4 ayes to 1 nays.

On a Motion from Councilman Cramer and second by Councilwoman Herman, Line Item #14204.01.0.0.000 – Attorney Contractual Expense was increased to $4,000.  The long roll vote was as follows:  Supervisor Johnson – Aye.  Councilwoman Herman – aye, Councilman Cramer – aye, Councilman Lonneville – aye, Councilwoman Taber – aye.  The motion was passed 5 ayes to 0 nays.

On a Motion from Councilman Lonneville and second by Councilman Cramer, Line Item #16204.01.0.018 – Building, Telephone was decreased to $3,000.  The long roll vote was as follows:  Supervisor Johnson – Aye.  Councilwoman Herman – aye, Councilman Cramer – aye, Councilman Lonneville – aye, Councilwoman Taber – aye.  The motion was passed 5 ayes to 0 nays.

On a Motion from Councilman Lonneville and second by Councilman Cramer, Line Item #50101.01.0.246 –  Highway Vehicle Expense was increased to $780.  The long roll vote was as follows:  Supervisor Johnson – Aye.  Councilwoman Herman – aye, Councilman Cramer – aye, Councilman Lonneville – aye, Councilwoman Taber – aye.  The motion was passed 5 ayes to 0 nays.

On a Motion from Councilwoman Herman and second by Councilman Cramer, Line Item #73101.01.0.083 –  Summer Recreation Director was decreased to $7,500.  The long roll vote was as follows:  Supervisor Johnson – Aye.  Councilwoman Herman – aye, Councilman Cramer – aye, Councilman Lonneville – aye, Councilwoman Taber – aye.  The motion was passed 5 ayes to 0 nays.

On a Motion from Councilman Lonneville and second by Councilman Cramer, Line Item #73101.01.0.084 –  Basketball Coordinator was increased to $1,500.  The long roll vote was as follows:  Supervisor Johnson – Aye.  Councilwoman Herman – aye, Councilman Cramer – aye, Councilman Lonneville – aye, Councilwoman Taber – aye.  The motion was passed 5 ayes to 0 nays.

On a Motion from Councilwoman Taber and second by Councilman Lonneville, Line Item #xxxxx –  Recreation Director was decreased to $15,000.  The long roll vote was as follows:  Supervisor Johnson – Naye.  Councilwoman Herman – aye, Councilman Cramer – aye, Councilman Lonneville – aye, Councilwoman Taber – aye.  The motion was passed 4 ayes to 1 nays.

BE IT RESOLVED, the Town of Marion received 1 proposals; and

BE IT RESOLVED, that the Marion Town Board authorizes the hiring of Jim Burgio Plumbing for the amount not to exceed $1,150 to be taken from account # 71102.01.0.063 at the amount of $500 and $650 to be taken from unappropriated fund balance; and

BE IT FURTHER RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk

Resolution #1003-2025 Amend Resolution #812-2025 Authorize Town Board to send an RFP Repair the Outdoor Bathroom Door and Lock in the Marion Town Park Pavilion A

WHEREAS, the Marion Town Board needs to have repairs made to the Outdoor access Bathroom to repair the door and lock at the Marion Town Park in Pavilion A; and

BE IT RESOLVED, the Town Board authorizes to send out an RFP to have repairs made to the outside access bathroom door at the Marion Town Park with estimates to be returned no later than November 11, 2025; and

BE IT FURTHER RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk

Resolution #1004-2025 Amend Resolution #912-2025  Payment of Claims

WHEREAS, the Marion Town Board needs to amend resolution #912-2025 to remove John L. Castelli, Gone Crusin’ Car Show refund of $250; and

BE IT RESOLVED, the Town Board authorizes the Principal Account Clerk to void the check that was written for Mr. Castelli and transfer $250 back to Money Market savings account; and

BE IT FURTHER RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk

Resolution #1005-2025  Payment of Claims

WHEREAS, the Marion Town Board authorizes the hiring of Human Resource Attorney, David Hou from Bond, Schoeneck and King to perform an impartial investigation of the complaint received by the Town of Marion; and

BE IT RESOLVED, the Town Board authorizes the payment of $280.00 per hour to be expensed from 14204.01.0.000 to be taken from unappropriated fund balance, to perform investigation and provide a report to the Marion Town Board upon completion and;

BE IT FURTHER RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk and David Hou

Resolution #1007-2025 Authorize Change in Sewer Unit Charges for 4087 North Main Street

On a motion by Councilman Cramer and seconded by Councilman Lonneville

The following resolution was approved.

WHEREAS, the Town of Marion has received notification from Wayne County Water & Sewer Authority, that the building located at 4087 North Main Street no longer has a water connection and should no longer be charged a base rate for Sewer and any debt services; and

BE IT RESOLVED, that the Marion Town Board authorizes the change in unit charges for the Property located at 4087 North Main Street to be zero; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Natalie Bauer, Wayne County Water and Sewer Authority, Code Enforcement Officer and the Town Assessor.

Resolution #1008-2025 Authorize Subsidiary Transfer

On a motion by Councilman Cramer and seconded by Councilwoman Herman

The following resolution was approved.

BE IT RESOLVED, that the Marion Town Board authorizes the following subsidiary transfer:

WHEREAS, park tractor gasoline expense was taken out of account #71104.01.000.044 – gas & electric; and

BE IT RESOLVED, the board approves a subsidiary transfer to account #71104.01.000.066 in the amount of $475.80; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

Additional Citizen Comments: None

Executive Session: The Town Board went into Executive Session on a motion from Councilwoman Herman and seconded by Councilman Cramer at 7:35pm to discuss employment history of a particular person.  The executive session was closed at 8:14pm on a motion from Councilwoman Herman and seconded by Councilman Cramer.

With no further business, on a motion by Councilman Cramer and seconded by Councilwoman Herman, Supervisor Johnson closed the meeting at 8:15pm.
