A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday, October 27, 2025 in the Marion Court Room.

Supervisor Johnson called the meeting to order at 6pm with a roll call done by Heidi Levan, Town Clerk/Clerk of the Board.

The following resolution was approved

A RESOLUTION IN SUPPORT OF CONGRESSMAN NICK LANGWORTHY’S ENERGY CHOICE ACT (H.R. 3699, S. 1945) AND IN OPPOSITION TO GOVERNMENT-MANDATED NATURAL GAS BANS

WHEREAS, affordable and reliable energy is essential to the health, safety, and economic prosperity of New York families, businesses, and communities; and WHEREAS, natural gas remains a dependable, cost-effective, and clean-burning energy source used by millions of New Yorkers to heat their homes, cook their food, and power their businesses; and

WHEREAS, in 2019, New York State enacted the Climate Leadership and Community Protection Act (CLCPA), which mandates aggressive emissions reductions and serves as the foundation for sweeping energy restrictions, including efforts to phase out natural gas; and

WHEREAS, building on the CLCPA, Governor Kathy Hochul and the New York State Legislature in 2023 enacted provisions in the state budget banning natural gas and other fossil fuel hookups in most new residential and commercial buildings, effective 2026 for smaller buildings, and 2029 for larger buildings, thereby eliminating consumer choice and limiting access to affordable energy; and

WHEREAS, Governor Hochul has publicly supported these bans and related measures as part of her administration’s climate and energy agenda, despite widespread concerns that such mandates will increase costs, strain grid reliability, and restrict energy diversity; and

WHEREAS, these top-down policies undermine affordability, threaten reliability during peak demand, and strip away the freedom of consumers and businesses to choose the energy sources that best meet their needs; and

WHEREAS, Congressman Nick Langworthy of New York and Senator Jim Justice of West Virginia introduced the Energy Choice Act (H.R. 3699, S. 1945), federal legislation that ensures state and local governments cannot restrict consumer access to natural gas and other affordable energy sources, thereby protecting freedom of choice for New Yorkers and all Americans; and

WHEREAS, the Energy Choice Act would safeguard households, small businesses, hospitals, farmers, and manufacturers from harmful government overreach and preserve access to an “allof-the-above” energy strategy that strengthens reliability and affordability;

NOW, THEREFORE, BE IT RESOLVED, that the Marion Town Board strongly supports the Energy Choice Act as introduced by Congressman Langworthy (H.R. 3699) and Senator Justice (S. 1945) and stands firmly opposed to New York State’s natural gas bans, the CLCPA-driven restrictions, and other state energy mandates that eliminate consumer choice; and

BE IT FURTHER RESOLVED, that the Marion Town Board urges Congress to pass the Energy Choice Act to defend consumer choice, protect energy affordability, and preserve reliable access to natural gas for New Yorkers; and

BE IT FURTHER RESOLVED, that copies of this resolution be sent to Congressman Nick Langworthy, Senator Jim Justice, the New York Congressional delegation, Senators Chuck Schumer and Kirsten Gillibrand, Governor Kathy Hochul, and leadership of the New York State Legislature.

Resolution #1012-2025 Authorize Intersection Survey for Warner Rd and Eddy Ridge Road and Warner Rd and Route 21

The following resolution was approved.

WHEREAS, the Marion Town Board has received a request for an intersection survey for Warner Rd and Eddy Ridge Rd. as well as State Route 21 at Warner Road; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to petition the Wayne County Highway Department and the New York State Department of Transportation to conduct a study on the above intersections to determine if a reduction for speed and/or three way stop signs can be installed; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to send a copy of this resolution to Wayne County Highway Department, NYS Department of Transportation and Marion Highway Department.

Resolution #1013-2025 Authorize Town Board to send an RFP for the Abatement Project for the Decommissioned Sewer Building

The following resolution was approved. 

WHEREAS, the Marion Town Board needs to have an abatement project completed for the decommissioned sewer building located on 4243 Smith Road in Marion, NY; and

BE IT RESOLVED, the Town Board authorizes publishing the request for proposals on the Town of Marion website with written proposals to be returned no later than December 31, 2025; and

BE IT FURTHER RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

Resolution # 1014-2025 Amend Resolution #714-2025 Authorization to apply for the 2026 JCAP grant through the New York Unified Court System

The following resolution was approved.

BE IT RESOLVED, The Board of the Town of Marion authorizes the Marion Town Court to apply for a JCAP grant in the 2025-26 grant cycle up to $30,000.

WHEREAS, that the Marion Town Board authorizes the Supervisor and Court Justice to sign all necessary documents regarding said grant; and

WHEREAS, that the Marion Town Board directs the Clerk of the Board to give a certified copy of this resolution to the Justice Court Clerk and the principal account clerk

Resolution #5 Authorize Hiring Part-time Maintenance

On a motion by Councilman Cramer and seconded by Councilwoman Herman, this resolution was tabled.

WHEREAS, the Marion Town Board authorizes the hiring of Nicholas Lucci of 3823 Warner Rd. Marion, NY, as part-time Maintenance for the Town of Marion with employment starting on November 3,2025; and

BE IT RESOLVED, the Town Board authorizes the following accounts to be used for payroll, 16202.01.0.159 at a rate of $20 per hour for no more than 9 hours per week and;

BE IT FURTHER RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk and Nick Lucci

Resolution #6 Authorize Agreement with Marion Senior Citizen Club

On a motion by Councilman Cramer and seconded by Councilman Lonneville, this resolution was tabled.

WHEREAS, the Town Board of the Town of Marion recognizes the importance of providing opportunities for senior residents to participate in social, recreational, and educational activities that enhance community engagement and quality of life; and

WHEREAS, the Town desires to support the Marion Senior Club by providing access to Town facilities and limited financial assistance for pre-planned activities and programs; and

WHEREAS, it is the intent of the Town Board to ensure that all expenditures of Town funds are made in accordance with applicable laws, procurement policies, and fiscal accountability standards;

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Marion hereby authorizes the use of the Marion Park Lodge by the Marion Senior Club for meetings and activities, subject to availability and scheduling coordination through the Town Clerk’s Office; and

BE IT FURTHER RESOLVED, that the Town Board shall allocate budgeted funds to support pre-planned Senior Club programs and activities, which may include but are not limited to:

  • Educational workshops;
  • Social luncheons and themed gatherings;
  • Recreational outings and fitness programs; and
  • Guest speakers and entertainment;

BE IT FURTHER RESOLVED, that all expenditures made with Town funds on behalf of the Marion Senior Club shall comply with the Town of Marion Procurement Policy and all applicable bidding laws, and that invoices must be submitted to the Town Clerk’s Office by the first Wednesday of each month for review and payment processing; and

 

BE IT FURTHER RESOLVED, that Town funds budgeted for the Marion Senior Club shall not be used for:

  • Payment of rent, space fees, or facility charges to outside entities;
  • Donations or contributions to religious organizations or faith-based groups;
  • Gifts, personal items, or expenses for individual use; or
  • Any expenses not directly related to pre-approved Senior Club programs or activities;

 

BE IT FURTHER RESOLVED, that the Town Board of the Town of Marion expresses its full support for the Marion Senior Club and encourages continued collaboration between the Club, Town staff, and the Board to provide enriching programs that benefit the senior community.

BE IT FURTHER RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk and Marion Senior Citizen Club.

 Resolution #1015-2025 Authorize the Supervisor to Renew a CD for the Cemetery Perpetual Care Funds of $15,200 into a 6 Month CD with Lyons National Bank at a Rate of 4.00%

The following resolution was approved.

WHEREAS, Cemetery Perpetual Care Funds were placed in a 6-month CD which needs to renewed; and

BE IT RESOLVED, the Marion town board authorizes the Supervisor to renew a 6-month CD with Lyons National Bank at a rate of 4.00% in the amount of $15,200; and

BE IT FURTHER RESOLVED, that any amount above $15,200 be transferred to the Money Market account ending in 2628; and

BE IT FURTHER RESOLVED, the Town of Marion directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

Resolution #1016-2025 Authorize to publish an RFP for Updating Lighting at Town Hall

WHEREAS, NYSERSA conducted a Clean Energy Communities Energy Study for the Town of Marion, NY in regards to energy efficiency at the Marion Town Hall; and

BE IT RESOLVED, the Town Board authorizes a Request for Proposal to replace lighting at the Marion Town Hall be published on the Town of Marion website; and

BE IT FURTHER RESOLVED, that the RFP’s must be submitted in writing to the Marion Town Clerk’s office by December 1, 2025; and

BE IT FURTHER RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

 BE IT RESOLVED, that the Marion Town Board authorizes re-appointing Megan Ryan, 3806 Huntley Rd. Marion, NY to the Board of Assessment Review for a term of 10/27/2025 – 9/30/2030; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Megan Ryan, Mike Rados, Adrienne Compton, and the Principal Account Clerk.

Resolution #10  Payment of Claims

On a motion by Councilman Cramer and seconded by Councilwoman Herman, this resolution was tabled.

WHEREAS, the Marion Town Board has received and audited the following claims; now

BE IT RESOLVED, that the Supervisor is hereby authorized to pay said claims upon receipt of the signed abstracts of audited claims from the Town Clerk.

Additional Citizen Comments:

Executive Session:  On a motion from Councilwoman Herman and seconded by Councilman Cramer, the Town Board moved to Executive Session to discuss Collecting Bargaining Agreement at 6:35pm

With no further business, on a motion by Councilman Cramer and seconded by Councilwoman Herman, Supervisor Johnson closed the meeting at 6:45pm.
