The Marion Town Board will allow residents who would like to speak for 3 minutes each with a maximum of 15 minutes of the meeting devoted to citizens’ comments.  There will be time allocated at both the beginning and the end of the meeting.

To Honor the Retirement

Timothy Boerman

WHEREAS, The Town of Marion, Wayne County, New York, would like to recognize Timothy Boerman (Tim) for his many years of service to the Town of Marion; and

WHEREAS, Over Tim’s 26-year career at the Town of Marion, he served as a Town Board Member from 1996 – 2003 and Highway Superintendent from 2006-2025; and

WHEREAS, Tim has deeply believed in and valued the Town of Marion and his service to the Town; and

WHEREAS, Tim’s hard work and dedication will be remembered by all of us; and

WHEREAS, we the Marion Town Board, by the authorities vested in us, do hereby unanimously and enthusiastically congratulate Timothy Boerman on a well-deserved retirement, look back on his accomplishments with gratitude and awe, and wish him all the very best for the future; and

NOW, THEREFORE, in recognition of his outstanding service, we hereby cause the Seal of the Marion to be affixed on this 5th day of January, 2026.

Resolution #1 Authorize Supervisor to Sign Town Clerk Annual Software Support Contract with Williamson Law Book

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the Town Clerk Annual Software Support Contract for 2026 with Williamson Law Book Company for an annual cost of $1,151.00 to be appropriated from account 14102.1.0.029; and

BE IT RESOLVED, the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk and Williamson Law Book Company.

 

 

Resolution #2 Authorize Supervisor to Sign Software License Agreement for Buildings & Code Enforcement with Williamson Law Book and Annual Software Support Contract

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the Software License Agreement for Building & Codes Enforcement with Williamson Law Book Company; and

 

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the Annual Software Support Contract for 2026 with Williamson Law Book as attached at an annual cost of $950.00 to be appropriated from account #80102.01.0.029; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk, Code Enforcement Officer and Williamson Law Book Company.

 

Resolution #3 Designate Legal Newspaper for The Town of Marion for 2026

BE IT RESOLVED, that the Marion Town Board authorizes the Times of Wayne County as the legal newspaper for the Town of Marion for the fiscal year commencing January 1, 2026; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to all Town of Marion Department Heads and the Times.

 

Resolution #4 Adopt 2026 Mileage Reimbursement Rate

WHEREAS, the Marion Town Board adopted a mileage reimbursement policy per resolution #030608; and

 

NOW BE IT RESOLVED, that the Marion Town Board sets the reimbursement rate @ $ .70 effective January 1, 2026; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to all Town employees and Department Heads.

 

 

 

 

Resolution #5 Authorize to Re-Appoint Town Attorney

BE IT RESOLVED, that the Marion Town Board re-appoints David Fulvio as Attorney for the Town of Marion for the calendar year 2026; and

 

BE IT RESOLVED, that David Fulvio shall be reimbursed for services performed on an as needed basis at the rate of $200.00 per hour; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Town of Marion Department Heads, and David Fulvio

 

Resolution #6 Authorize the Town Clerk to Advertise Town Board Meetings for 2026

BE IT RESOLVED, Authorize the Town Clerk to advertise in the legal newspaper for the Town of Marion as follows:

 

BE IT RESOLVED, The Marion Town Board meetings for 2026 will be held on the 2nd and 4th Monday of each month except for federal holidays.  If a federal holiday falls on a Monday, the Marion Town Board will meet on Tuesday of that week.  All meetings are held in the Marion Court Room located at 3827 N. Main Street, Marion, NY  14505 and, All meetings start at 6:30 p.m. and are open to the public.

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

 

Resolution #7 Authorize to advertise for Request for Proposals for Main Street Lawn Care and Maintenance

Resolution #8 Authorize to advertise for Request for Proposals for 3 Abandoned Cemeteries Lawn Care and Maintenance

Resolution #10 Amend Budget to Reflect Hour adjustment for Deputy Town Clerk

BE IT RESOLVED, the Marion Town Board recognizes that a change is needed in the hours for the Deputy Town Clerk for 2026 from 32.5 hours per week to 33 hours per week; and

 

THEREFORE, the following budgetary items will be amended to reflect the yearly wage increase from $32,110. increased to $32,604. a difference of $494.00; and

 

BE IT RESOLVED that the account 14101.01.0.036 is now amended to $32,604 for the year 2026; and

 

BE IT RESOLVED, the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Deputy Town Clerk and Principal Account Clerk.

 

Resolution #11 Authorization for the Supervisor to Register and Attend the Association of Towns New Officials Training Conference in Corning, New York.

BE IT RESOLVED, that the Town Board authorizes for the Supervisor to Register and Attend the Association of Towns New Officers training conference in January located in Corning NY; at the cost of $250.00 to be expensed out of account, 12204.01.0.016; and

 

BE IT RESOLVED, the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk and the Supervisor.

 

Resolution #12 Authorize Re-Appointment of Mark Plyter as Dog Control Officer

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Mark Plyter and the Principal Account Clerk.

Resolution #18 Set a Public Hearing to use Reserve Funds for Employee Benefit Compensation.

WHEREAS, the employee moved from a salary position to an elected position from the Town of Marion Highway Department; and

 

BE IT RESOLVED, that the Marion Town Board sets a public hearing to utilize compensated absences for the employees approved compensation. The public hearing is set for January 26, 2026 and 6:30pm in the Marion Court Room; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

 

Resolution #19 Authorize to Re-Appoint of Timothy Short to the Drainage Committee

Resolution #21 Authorize to Amend Resolution # 413-2025 Re-Appointment of Assessor

BE IT RESOLVED, that the Marion Town Board amends resolution #413-2025 Re-appointment of Assessor to reflex 2026 rate of pay; and

 

BE IT RESOLVED, that Michael Rados shall be reimbursed for services performed as the Town of Marion Assessor at a rate of $17 per parcel (2,145 parcels) for an annual salary of $36,465; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Michael Rados and the Principal Account Clerk.
