Marion Municipal Building
Monday, January 3, 2022
A Town Board Organizational meeting of the Town of Marion, Wayne County, NY was held on Monday, January 3, 2022 at the Marion Municipal Room.
Supervisor Bender called the meeting to order at 6:30 pm with a roll call done by Heidi Levan, Clerk of the Board.

Supervisor Bender asked everyone to stand and give the Pledge of Allegiance and then read the following statement:
If you are attending a Town Board Meeting have not signed up for Public Participation Section of the Town Board Meeting pursuant to the rules which have been established (24 hours prior to start of meeting), then you will not be able to express your opinion. As a courtesy to those who attend the Board Meeting, you are requested not to interrupt the meeting, and refrain from conversation that would interfere with those attending being able to hear the Board transact its business. If in fact someone interferes with the meeting or the conversation with other spectators should require a warning and it is ignored, the person could be charged with Disorderly Conduct. For public hearings, speaking will be limited to topics on the agenda.
Town Business:
Councilman Cramer spoke first regarding the statement Supervisor Bender read. Councilman Cramer does not feel a 24 hour advanced noticed is necessary to speak however, he is fine with this in place. Councilman Cramer stated that if this is the rule, then rules need to be followed. Councilman Cramer did ask that an additional Public Comment section be added to the end of the agenda. This would allow anyone in the audience to speak for 3 minutes on any topic that was discussed in that evenings Town Board Meeting. Supervisor Bender and the other Council members agreed to this additional public comment section. Councilman Cramer did state he is aware this is a meeting in the public and not a meeting for the public to interrupt. Councilwoman Herman asked if Councilman Cramer would be willing to help Supervisor Bender keep time and keep the meeting in order. Councilman Cramer agreed.
Town Clerk, Heidi Levan, spoke next regarding meeting days and times for 2022. The Town Board decided to keep meeting on the 2nd and 4th month each month at 6:30pm, except for any Monday that falls on a federal holiday. If a meeting falls on a federal holiday, the meeting will take place on Tuesday of that same week.
Councilwoman Herman shared that Attorney Roy Franks is moving his business to Walworth. Councilman Lonneville will reach out to business owner Tom Salviski to find out what can be done with yet another empty building in town.
Councilwoman Herman and Councilman Cramer will both be attending online newly elected officials training. Councilman Lonneville asked if Planning and Zoning Boards will be receiving trainings anytime soon. Town Clerk will speak with Planning and Zoning Board clerk, Adrienne Compton to ask.
Town Clerk Heidi Levan next asked who would like to receive their Board information electronically. Councilman Cramer and Councilwoman Herman would like their information electronically before the meeting and a hard copy at the meeting.

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the Town Clerk Annual Software Support Contract for 2022 with Williamson Law Book Company for an annual cost of $864.00 to be appropriated from account 14102.1.0.029; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk and Williamson Law Book Company.

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the Annual Software Support Contract for 2022 with Williamson Law Book as attached at an annual cost of $714.00 to be appropriated from account #80102.01.0.029; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk, Code Enforcement Officer and Williamson Law Book Company.

BE IT RESOLVED, that the Marion Town Board authorizes the Times of Wayne County as the legal newspaper for the Town of Marion for the fiscal year commencing January 1, 2022; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to all Town of Marion Department Heads and the Times.
Resolution #1042022 Adopt 2022 Mileage Reimbursement Rate

WHEREAS, the Marion Town Board adopted a mileage reimbursement policy per resolution #030608; and
NOW BE IT RESOLVED, that the Marion Town Board sets the reimbursement rate @ $ 58.5 cents effective January 1, 2022, and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to all Town employees and Department Heads.

BE IT RESOLVED, that the Marion Town Board re-appoints Arthur B. Williams as Attorney for the Town of Marion for the calendar year 2022; and
BE IT RESOLVED, that Mr. Williams shall be reimbursed for services performed on an as needed basis at the rate of $175.00 per hour; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Town of Marion Department Heads, and Arthur Williams.
Resolution #1062022 Authorize the Town Clerk to Advertise Town Board Meetings for 2022

The following resolution was adopted
BE IT RESOLVED, Authorize the Town Clerk to advertise in the legal newspaper for the Town of Marion as follows:
BE IT RESOLVED, The Marion Town Board meetings for 2022 will be held on the 2nd and 4th Monday of each month except for federal holidays. If a federal holiday falls on a Monday, the Marion Town Board will meet on Tuesday of that week. All meetings are held in the Marion Municipal Building located at 3827 N. Main Street, Marion, NY 14505 and/or ZOOM. All meetings start at 6:30 p.m. and are open to the public.
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.
Resolution #1072022 Authorize Supervisor to sign 2022/2023 Contract with Wayne County Humane Society

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the attached 2022/2023 Contract with Wayne County Humane Society; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Wayne County Humane Society and Principal Account Clerk.
Resolution #1082022 Authorize Permit Fee Schedule

WHEREAS, the Town Board Authorizes the 2021 fee schedule for 2022; now
BE IT RESOLVED, that the Marion Town Board accepts 2021 fee schedule for 2022; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a passed copy of this resolution to the Code Enforcement Officer, Chief Operator WWTP and the Town Clerk.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Julie Herman, Mike Cramer and the Principal Account Clerk.
With no further business, on a motion by Councilman Bliek and seconded by Councilman Cramer, Supervisor Bender closed the meeting at 7:08pm.
