MARION ZONING BOARD OF APPEALS MINUTES

June 30, 2020

Time: 6:33pm. Gregg Bell called the meeting to order.

Present: Gregg Bell, John Lonneville, Zachary Bartlett, Michael Hershelman and Martha Rich
Absent: Andrea Vandergrift and Dan Sargent
Also present: Jeff and Cindy Casper, Bradley Velte

6:35 pm – Gregg Bell announced that the voting members are Gregg Bell, John Lonneville, Michael
Hershelman, Zachary Bartlett and Martha Rich

6:36 pm – Gregg asked the board if they had any comments or questions regarding the previous meeting
minutes or workshop summary. No comments.
Martha Rich made a motion to approve the minutes from May 26, 2020 and workshop summary
from June 16, 2020. Michael Hershelman seconded the motion. All in favor. None opposed. Motion
carried.

New Business: Gregg Bell stated that there are two items on tonight’s agenda.

6:37pm – The first item is Application A-4-20: Jeff and Cindy Casper – Requesting an area variance to
build an accessory building in front of the principle building at 4064 Reeves Rd Marion, NY 14505
Zoning Ordinance: 308-9B
Gregg Bell asked Mr. Casper to explain his request:

Mr. Casper plans to build a smaller home on a lot of his land and would like to have an accessory
building in front of the home. The accessory building will be built prior to the home.

6:40pm –The board was presented with proof of the neighbor notifications and had no questions.
Michael Hershelman made a motion to approve the neighbor notification as discussed. Martha
Rich seconded the motion. All in favor. None opposed. Motion carried.

6:42pm – Gregg Bell and the board reviewed the Agricultural Data Statement, no significant findings or
questions from the board.
Gregg Bell and the board completed/reviewed Section II of the SEAF which is on file in the
applicant’s folder. Gregg Bell stated part III is N/A.
Martha Rich made a motion to approve the Agriculture Data Statement and SEAF. Zachary
Bartlett seconded the motion. All in favor.

6:43pm –Gregg Bell opened the Public Hearing.

6:44pm –Gregg Bell closed the Public Hearing as there were no members of the public with any
comments.

6:45pm –Gregg Bell reviewed the Area Variance worksheet with the Board, completed worksheet is
available in applicant’s folder.

6:54pm – Gregg Bell asked the board if they had any additional questions of comments.
No additional questions at this time.

6:57pm –Martha Rich made a motion to approve the application to build an accessory building in front of
the proposed residence at 4064 Reeves Rd Marion, NY 14505. To be built within general conformance of
plot plan provided with application.
Michael Hershelman seconded the motion

6:58pm – All approved. None opposed. Motion carried Application A-4-20 approved.

6:59pm – The second item is Application A-5-20: Bradley Velte – Requesting an area variance to build an
accessory building with a 1’ property setback at 4701 Williamson Rd Marion, NY 14505
Gregg Bell asked Mr. Velte to explain his request:
Mr. Velte explained he would like to build an accessory building on the corner of his lot by his
driveway which would only allow a 1’ setback from property line

7:01pm –The board was presented with proof of the neighbor notifications and had no questions.
Zachary Bartlett made a motion to approve the neighbor notification as discussed. Martha Rich
seconded the motion. All in favor. None opposed. Motion carried.

7:05pm – Gregg Bell and the board reviewed the Agricultural Data Statement, no significant findings or
questions from the board.
Gregg Bell and the board completed/reviewed Section II of the SEAF which is on file in the
applicant’s folder.
Martha Rich made a motion to approve the Agriculture Data Statement and SEAF. John
Lonneville seconded the motion. All in favor.

7:06pm –Gregg Bell opened the Public Hearing.

7:07pm –Gregg Bell closed the Public Hearing as there were no members of the public with any
comments.

7:08pm – Gregg Bell asked the board if they had any additional questions of comments.
Zach Bartlett asked how tall the building would be, Mr. Velte stated 14’.
Michael Hershelman asked where the septic system was located. Mr. Velte stated the septic
system was located in front of the house.

7:12pm –Gregg Bell reviewed the Area Variance worksheet with the Board, completed worksheet is
available in applicant’s folder.

7:13pm –Martha Rich made a motion to approve the application to build an accessory building with a 1’
corner setback per plans provided with application.
Michael Hershelman seconded the motion

7:14pm – All approved. None opposed. Motion carried Application A-5-20 approved.

7:15pm – No old business

7:16pm – Martha Rich moved to adjourn the meeting. Michael Hershelman seconded. Meeting
adjourned
