MARION ZONING BOARD OF APPEALS MINUTES

April 28, 2020

Time: 6:38pm. Gregg Bell called the meeting to order.

Present: Gregg Bell, John Lonneville, Daniel Sargent , Zachary Bartlett, Michael Hershelman and Martha Rich
Absent: Andrea Vandergrift
Also present: Jon Hunter and William Murphy

6:40 pm – Gregg Bell announced that the voting members are Gregg Bell, John Lonneville, Dan Sargent, Zachary Bartlett
and Martha Rich

6:41 pm – Gregg asked the board if they had any comments or questions regarding the previous meeting minutes. No
comments.
Dan Sargent made a motion to approve the minutes from October 29, 2019. Zachary Bartlett seconded the
motion. All in favor. None opposed. Motion carried.

New Business: Gregg Bell stated that there are two items on tonight’s agenda.

6:42pm – The first item is Application A-1-20: Bill Murphy – Requesting an Area Variance to build 24’x30’ building in
corner lot within 6’ and 10’ of corner property line at 3728 Walworth Rd Marion, NY 14505.
Gregg Bell asked Mr. Murphy to explain his request:
Mr. Murphy would like to build a 24’ by 30’ pole barn with a 16’ overhead door. Y\This will be built in the Southwest
corner of the property mainly to house military vehicles and additional storage. The pole barn will be 14’ tall.

6:44pm –Gregg Bell opened the Public Hearing.

6:45pm –Gregg Bell closed the Public Hearing as there were no members of the public with any comments.

6:46pm – Gregg Bell asked the board if they had any additional questions of comments

6:48pm – Gregg Bell and the board reviewed the Agricultural Data Statement, no significant findings or questions from the board.
Dan Sargent made a motion to approve the Agriculture Data statement. Martha Rich seconded the motion. All in favor.

6:50pm – Gregg Bell and the board completed/reviewed Section II of the SEAF which is on file in the applicant’s folder. Gregg Bell
stated part III is N/A.

6:51pm –Gregg Bell reviewed the Area Variance worksheet with the Board, completed worksheet is available in applicant’s folder.

6:57pm – Gregg Bell asked the board if they had any additional questions of comments. No additional questions at this
time.

6:58pm –Martha Rich made a motion to approve the application to build a 24’ x 30’ pole barn in rear corner of property
to be within minimum 6’ from West property line and 10’ minimum of South property line at 3728 Walworth Rd Marion,
NY 14505.
Zachary Bartlett seconded the motion

7:00pm – All approved. None opposed. Motion carried Application A-1-20 approved.

7:01pm – The second item on the agenda is Application A-2-20: Jon Hunter – Requesting a Use Variance/Special
Permit to add a second residence to the property at 4311 Greenfield Dr Marion, NY

Gregg Bell asked Mr. Hunter to explain his request:
Mr. Hunter would like to build a 3000sq ft pole barn on his newly purchased 30 acres of property off Greenfield Dr.
Out of the 3000sq ft he would like 1000sq ft to be an in-law apartment for his in laws during the summer months. The pole
barn will be built around 300ft from the road.

7:06pm –Gregg Bell opened the Public Hearing.

7:07pm –Gregg Bell closed the Public Hearing as there were no members of the public with any comments.

7:08pm – Gregg Bell asked the board if they had any additional questions of comments

7:09pm – Gregg Bell and the board reviewed the Agricultural Data Statement, no significant findings or questions from the board.

Martha Rich made a motion to approve the Agriculture Data statement. Dan Sargent seconded the motion. All in favor.
7:10pm – Gregg Bell and the board completed/reviewed Section II of the SEAF which is on file in the applicant’s folder. Gregg Bell
stated part III is N/A.
John Lonneville made a motion to approve the SEAF. Martha Rich seconded the motion. All in favor.

7:12pm – Gregg Bell reviewed the Area Variance worksheet with the Board, completed worksheet is available in applicant’s folder.

7:18pm – Gregg Bell asked the board if they had any additional questions of comments. No additional questions at this
time.

7:19pm – Martha Rich made a motion to approve the Special Permit for Application A-2-20 (4311 Greenfield Dr, tax
account 66115-00-130278) to allow an in-law apartment in the detached-out building (Pole barn) behind the property.
NY 14505.
Dan Sargent seconded the motion

7:20pm – All approved. None opposed. Motion carried Application A-2-20 approved.

7:21pm – No new business

7:22pm – Martha Rich moved to adjourn the meeting. Zachary Bartlett seconded. Meeting adjourned
