A Town Board meeting of the Town of Marion, Wayne County, NY was held on

Monday, January 4, 2021 in the Marion Municipal Room and via ZOOM conference service.

Supervisor Bender called the meeting to order at 6:30pm.  This meeting was held at the Marion Municipal Room and via Zoom on-line conference service.  This meeting was the Organizational Meeting for 2021.

Supervisor Bender asked for a roll call after asking everyone to stand and give the Pledge of Allegiance.

Town Business: 

Supervisor Bender spoke about the Public Employer Health Emergency Procedure Plan for the Town of Marion.  The Town Board discussed each page of the plan and made corrections.  Town Clerk, Heidi Levan will make the requested changes and send the document back to the Town Board to review.  The Town Board hopes to review and pass the amended plan at their January 11, 2021 meeting.

Supervisor Bender next stated she had talked to Attorney Art Williams regarding the Amended and Restated Agreement for the Regional Water Storage Tank.  Supervisor Bender asked Councilman Bliek if he was aware of any changes that required an amendment.  A discussion was held.

Supervisor Bender next spoke about the letter that Town Attorney, Art Williams has sent to Marion resident, Barbara Fersaci. Ms. Fersaci has until January 31, 2021 to address the Code Violation at 3843 North Main street in Marion.

Councilwoman Smith spoke next regarding Town Holiday’s.  Councilwoman Smith stated that she feels the Town Office should be closed on Federal Holiday’s similar to the Town Clerk’s Office.  A long discussion was had by all Town Board members.  A resolution was added to amend the Town of Marion Employee handbook.  Councilwoman Fisher stated that the Town Board should be reviewing and making necessary corrections to the Employee handbook.  The Town Board agreed to work on this at each 4th Monday of the month until it has been completely reviewed.

Resolution #1012021 Authorize Supervisor to Sign Town Clerk Annual Software Support Contract with Williamson Law Book

The following resolution was adopted

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the Town Clerk Annual Software Support Contract for 2021 with Williamson Law Book Company for an annual cost of $785.00 to be appropriated from account 14102.1.0.029; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk and Williamson Law Book Company.

Resolution #1022021 Authorize Supervisor to Sign Software License Agreement for Buildings & Codes Enforcement with Williamson Law Book and Annual Software Support Contract

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the Software License Agreement for Building & Codes Enforcement with Williamson Law Book Company; and

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the Annual Software Support Contract for 2021 with Williamson Law Book as attached at an annual cost of $649.00 to be appropriated from account #80102.01.0.029; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk, Code Enforcement Officer and Williamson Law Book Company.

Resolution #1032021 – Designate Legal Newspaper for The Town of Marion For 2021

The following resolution was adopted

BE IT RESOLVED, that the Marion Town Board authorizes the Times of Wayne County as the legal newspaper for the Town of Marion for the fiscal year commencing January 1, 2021; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to all Town of Marion Department Heads and the Times.

 Resolution #1042021 Adopt 2021 Mileage Reimbursement Rate

On a motion by Councilwoman Fisher and seconded by Councilwoman Smith

The following resolution was adopted

WHEREAS, the Marion Town Board adopted a mileage reimbursement policy per resolution #030608; and

NOW BE IT RESOLVED, that the Marion Town Board sets the reimbursement rate @ $ .56 effective January 1, 2021, and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to all Town employees and Department Heads.

Resolution #1052021 Re-Appoint Town Attorney

BE IT RESOLVED, that the Marion Town Board re-appoints Arthur B. Williams as Attorney for the Town of Marion for the calendar year 2021; and

BE IT RESOLVED, that Mr. Williams shall be reimbursed for services performed on an as needed basis at the rate of $175.00 per hour; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Town of Marion Department Heads, and Arthur Williams.

Resolution #1062021 Authorize the Town Clerk to Advertise a Town Board Meetings for 2021

BE IT RESOLVED, Authorize the Town Clerk to advertise in the legal newspaper for the Town of Marion as follows:

BE IT RESOLVED, The Marion Town Board meetings for 2021 will be held on the 2nd and 4th Monday of each month except for federal holidays.  If a federal holiday falls on a Monday, the Marion Town Board will meet on Tuesday of that week.  All meetings are held in the Marion Municipal Building located at 3827 N. Main Street, Marion, NY  14505 and/or ZOOM.  All meetings start at 6:30 p.m. and are open to the public.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

 The following resolution was adopted

BE IT RESOLVED, The Marion Town Board is amending the Town of Marion Employee Handbook, Section 801 Holidays and;

BE IT RESOLVED, The new Holidays for Town Employees are as follows:

New Years Day, Martin Luther King Jr Day, President’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Day after Thanksgiving, Christmas Day, Columbus Day, Veteran’s Day and one floating holiday to be used on either Christmas Eve or New Year’s Eve for a total of 12 paid holidays for full time staff and;

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolutions to all Town Employees.

With no further business, on a motion by Councilwoman Fisher and seconded by Councilwoman Smith, Supervisor Bender closed the meeting at 7:55pm.
