Monday, June 8, 2020
A Town Board meeting of the Town of Marion, Wayne County, NY was held on
Monday, June 8, 2020 at the Marion Town Park.
Supervisor Bender called the meeting to order at 6:32pm. This meeting was conducted using social distancing at the Marion Town Park due to the COVID-19 social distancing restrictions.

Supervisor Bender asked for a roll call. Supervisor Bender asked everyone who could stand to please do so and recite the pledge of allegiance to the American flag. Supervisor Bender next welcomed everyone to the meeting. She stated how nice it was to see everyone in person even if it was social distanced and with face masks.
Town Business:
Councilman Lonneville started the Town Business discussing the Mill Street project. The project is moving along nicely. Sidewalks are starting to be installed. Councilman Lonneville has asked Highway Superintendent, Tim Boerman to keep in touch with Wayne County Highway, as the County oversees this project. Councilman Lonneville also spoke with Brian Frey from Wayne County Highway Department regarding drainage on Maple Ave. in Marion. This is a big project and will need to be thought about in the future when the Town Budget is created.
Supervisor Bender next opened the Public Hearing regarding unappropriated fund balance at 6:40pm. Town Clerk, Heidi Levan read the legal notice as follows:

NOTICE IS HEREBY GIVEN that the Marion Town Board will meet and hold a Public Hearing in regards to sidewalk improvements on Maple Ave for the amount not to exceed of $13167 from unappropriated fund balance.
FURTHER NOTICE is hereby given that the Public Hearing will be held on Monday, June 8, 2020 at 6:30 pm in the Marion Municipal Building, 3827 North Main Street at which time all persons will be heard in favor or against any items therein contained.
The public hearing was closed at 6:42pm on a motion from Councilman Bliek and seconded by Councilman Lonneville with not comments for or against the project.
Supervisor Bender wanted to thank the Marion Highway Department for planting trees along the Marion Town Park property. These trees were donated by Wayne County Soil & Water.
Councilman Lonneville spoke next regarding a request from Planning and Zoning secretary, Angela Patterson to update the Town of Marion website. Councilman Lonneville has contacted former Town of Marion Supervisor Nicholas Deming to see if he was available to work on the Marion website. Mr. Deming is willing to donate a few hours of his time. Ms. Patterson spoke next. The project would include a test page for the Planning and Zoning pages for the Town of Marion. Planning Board Chairman, Fred Walker spoke next. Mr. Walker stated that the Planning Board had talked about updating the pages of the Planning Board on the Town website but not official decision had been made as to what should or should not be on the new page. Zoning Board member, John Lonneville stated that the Town of Marion website and Zoning ordinances were very out of date. He would like to see updates made in both the website and Ordinances. Much discussion took place among the Town Board members regarding the website. Resident Nicholas Lent spoke up and stated that he just graduated from Wayne Fingerlakes BOCES Computer Science program. Mr. Lent stated the Town of Marion should contact BOCES to see the Computer Science program would in interested in designing a new website for the Town. Mr. Lent also offered his services to the Town. The Town Board will contact WFL BOCES.
Citizens Comments:
Nicolas Lent, graduating Senior from Marion High School, spoke regarding the Hometown Hero’s project. 28 banners have been delivered to the Marion Highway Department. A second round of banners may happen soon. Highway Superintendent, Tim Boerman stated that the Marion Highway Department will start to work hanging the banners this week. The hope is to have the banners hung by Tuesday, June 16th for the Marion Seniors car parade.
Marion Historian, Caryn Devlin spoke next. Ms. Devlin is looking for Marion residents would would be willing to serve on a Wayne County Bi-centennial committee. Wayne County will be celebrating a Bi centennial in 2023. If interested in helping to plan the celebrations in Marion, please contact Ms. Devlin.
Committee Reports:
Supervisor Bender: Town Clerk
Supervisor Bender stated that the flowers purchased from Spring Valley Greenhouse that were damaged and returned to Spring Valley should be returning to Marion in the next few days.
Supervisor Bender wanted to share with the Town Board that a car parade for Marion Senior High School graduates will take place on Tuesday, June 16 at either 6:15 or 6:30pm. She asked Town Board members to please join her in front of the Town Hall to cheer on the graduating class.
Supervisor Bender wanted to Thank Councilwoman Debbie Smith, Court Clerk Eileen Steurrys, Town Clerk Heidi Levan, Public Health staff Ryan Mulhurn and Kim Williams for distributing face covering masks on Saturday, May 30th. Supervisor Bender also help distribute masks as well. Masks are still available for the pickup from the Town Clerk’s office.
Supervisor Bender has noticed that currently there are no cross-training employees withing the Town staff. She would like to discuss this more at a future meeting.
Councilman Bliek: Deputy Supervisor, Highway, Drainage, Water, Sewer
Councilman Bliek spoke next. A question has been brought up as to which taxpayers will be charged a debt service charge for a new water storage tank being built in Sodus. This storage tank will help increase water pressures and service to Marion water users. This will be discussed more at a meeting to take place at Wayne County Water & Sewer Authority.
Next, Coucilman Bliek asked Highway Superintendent, Tim Boerman to give a report on the Highway Department. Mr. Boerman stated that the Highway department has removed all the plow equipment from the trucks and has them painted and ready for the fall. The Highway Department also prepared and replaced the mulch on the playgrounds within the Town Park. Mowing is continuing to be done on the roadsides. 5 miles of roads have been resurfaced with oil and stone.
Councilwoman Fisher: Parks, Recreation, Assessor
Councilwoman Fisher wanted to thank the Marion Highway Department for mulching the playgrounds at the Marion Town Park. They look great!
Councilwoman Fisher also stated that Marion Recreation has been cancelled this was done at a previous Town Board Meeting. Governor Cuomo has now stated that Summer Recreation Day Camps can resume in July of 2020. A lot of questions and comments have been posted on social media regarding this typic. It takes months of planning and unfortunately, the Town does not have enough time to get this done for the summer of 2020.
Councilwoman Fisher spoke next regarding Assessments. Our current assessment rate is 90%. Councilwoman Fisher would like to invite Town Assessor, Dawn VanPatten to the next Town Board meeting to discuss possible re-evaluations for the Town of Marion in the near future.
Councilwoman Fisher spoke next regarding the Marion Town Park. The Town Park will have a Port-a-Potty delivered this week for people who use the park for walking. This Port-a-Potty will be cleaned by the company supplying the unit once every 10 days.
Councilwoman Fisher next spoke about a request from a resident to have a Food Truck at the Town Park. The Town Board had a lengthy discussion regarding this subject. If a Food Truck wished to stop and drop off food to an individual, this would be allowed. A reminder to everyone, alcohol is not allowed within the park.
Councilwoman Smith: Public Safety, Judicial, Library, Cemetery
Councilwoman Smith stated the staff at the Marion Public Library is going back to work next week. 50% of staff will work at one time and will be offering curbside pickup for materials owned by the Marion Library.
Councilwoman Smith also stated that the Marion Cemetery Association has hired new people to mow and trim the cemetery property. This is going very well. The Marion Highway Department have dug 5 graves for the Marion Cemetery Association and will bill in the near future for their time.
Councilman Lonneville: Historian, Zoning & Planning
Councilman Lonneville stated the Marion museum, Jennie’s House, has been prepared for a new concrete porch apron. The preparation was done by Duane Smeatin and the Marion Highway Department. Thank you to all who have helped to get this project ready. Scott Roegiers will pour the concrete in the near future. Thank you to Caryn & Mark Devlin for planting trees at the museum. These trees were given to the Town of Marion by Wayne County Soil & Water. Councilman Lonneville asked Town Historian Caryn Devlin if she had anything to add. Ms. Devlin stated that she hoped everyone had noticed that during the month of May, she posted pictures of Marion WWII veterans on the Town Historian Facebook page. Councilman Lonneville wanted to thank Ms. Devlin for this project, because of this project Councilman Lonneville was able to learn new information regarding his own father who was a Marion WWII veteran.

BE IT RESOLVED that the Marion Town Board received a letter from Gary and Diana Combs regarding reducing sewer units from 4 to 3 for 4128 North Main Street as one of the four apartments is used for storage and is not rented; and
BE IT FURTHER RESOLVED, The Code Enforcement Officer inspected the house and found the apartment in question is no longer used for rental and would reduce this current four- family house to a three-family house in compliance with the Town of Marion building and zoning codes; and
BE IT FURTHER RESOLVED, the Code Enforcement Officer have the property owner sign a statement of reduction from a four-family to a three-family which in turn will reduce sewer units from 4 to 3 and;
BE IT RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Duane Smeatin, WCWSA, Gary & Diana Combs and the Principal Account Clerk.
