Monday, April 13, 2020
A Town board meeting of the Town of Marion, Wayne County, NY was held on
Monday, April 13, 2020 in the Marion Municipal Room.
Supervisor Bender called the meeting to order at 6:30pm. This meeting was conducted online due to the COVID-19 social distancing restrictions. The meeting was conducted using Zoom.com.

ABSENT:
OTHERS IN ATTENDANCE: Duane Smeatin, Code Enforcement Officer; Kathy Cauwels, Town of Marion Principal Account Clerk, and Marion students, Issac DeFisher and Katelynn Augello. Other people attended the meeting but did not identify themselves.
The meeting started at 6:30pm. Supervisor Bender asked for a roll call. There was no visible American Flag, so the Pledge of Allegiance was not recited. Supervisor Bender welcomed the Marion High School students in attendance.
Town Business:
Supervisor Bender wanted to publicly thank the Marion Highway Department for roping off the Marion Town Park playground with closed signs. The playground is closed due to the NYS Pause order currently in place by Governor Cuomo.
Supervisor Bender stated that she had spoken to Brian Frey from the Wayne County Highway Department. The Mill Street project is currently on hold due the New York State Pause order currently in place by Governor Cuomo.
Councilwoman Fisher spoke first regarding the Marion Recreation Spring Baseball/Softball season. After careful consideration, the 2020 Spring season has been cancelled. Councilwoman Fisher will work with baseball coordinator, Ashley Tack to address refunding anyone who paid for registration.
Councilwoman Fisher next spoke about the need to either replace or repair the basketball courts at the Town Park. Councilman Lonneville would like a maintenance plan if the courts are repaired or replaced.
Supervisor Bender would like to hold off on any decisions regarding the basketball courts until Fall due to the current COVID-19 pandemic.
Councilwoman Smith stated the the E-Waste pick up originally scheduled for May 2020 has been postponed. Councilwoman Smith will look to reschedule this event in September. More details to come at a later date.
Committee Reports:
Supervisor Bender: Town Clerk
Supervisor Bender stated that the Town Clerk’s office is now done collecting 2020 Town & County taxes.
Councilman Bliek: Deputy Supervisor, Highway, Drainage, Water, Sewer
Councilman Bliek reported that the Highway Department has been busy sweeping the roads in Marion. The Highway Department has also rolled the fields at the Town Park.
Councilman Lonneville: Historian, Zoning & Planning
Councilman Lonneville stated that he is very disappointed that work is not being done at Jennie’s House. Councilman Lonneville feels this would be an excellent time for Code Enforcement officer Duane Smeatin to be working at Jennie’s house. Councilman Lonneville would also like the Marion Highway Department to remove topsoil at Jennie’s house so the concrete work can begin. Councilman Lonneville would like to know what is an essential worker mean? Who is considered essential? Supervisor Bender offered to check with the County to get some answers and will report back to the board.
Councilwoman Smith: Public Safety, Judicial, Library, Cemetery
Councilwoman Smith did not have anything to report because NYS has closed all courts in New York State and the Marion Public Library is closed. Both are closed due to the NYS Pause order that was put in place by Governor Cuomo. Councilwoman Smith asked about the Cemetery meeting that was scheduled to take place in late March. This meeting has been postponed. Councilwoman Smith will contact the Marion Cemetery Association to see when the meeting is being rescheduled for.
Councilwoman Fisher: Parks, Recreation, Assessor
Councilwoman Fisher stated she is still waiting to make a decision regarding the 2020 Summer Recreation Program. Councilwoman Fisher also stated she has spoken with Nick Deming. The price to install new security cameras at the Marion Town Park will cost approximately $2,000.
Councilwoman Fisher did not have anything to report regarding the Assessor.

WHEREAS, the Marion Town Board duly held a public hearing on October 28, 2019, for the purpose of authorizing an appropriation from Park Reserve 230.01; and
BE IT RESOLVED, that the Marion Town Board awards the bid to Prestons Home & Garden and authorizes the appropriation from 230.01 in an amount not to exceed $15,900 to purchase mulch for the playground;

NOTICE IS HEREBY GIVEN that the Town Board will hold a Public Hearing on May 11, 2020, at 6:30 for the purpose of passing Local Law #1 2020 to prohibit use of tobacco and e-cigarettes upon real property owned or leased by the Town of Marion.

Resolution #4052020 Authorize Public Hearing for Appropriation from Park Reserve to Replace/Repair Asphalt at the Playground
This resolution was TABLED on a motion from Councilwoman Fisher and seconded by Ron Lonneville.
WHEREAS, the Town of Marion desires to repair/replace asphalt on the basketball court at the playground; now
BE IT RESOLVED, that the Marion Town Board authorizes the Clerk of the Board to advertise in the legal newspaper for the Town of Marion that a public Hearing will be held May 11, 2020 @ 6:45 pm at the Marion Municipal Room for the purpose of authorizing the appropriation from park reserve; and

WHEREAS, the Marion Town Board has authorized the refund of two Marion Town Park Reservation fee and deposit for the summer of 2020 for Maria Wells due to the COVID-19 pandemic; now
BE IT RESOLVED, that the Supervisor is hereby authorized to sign the payment of the refunds; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.
With no further business, on a motion by Councilman Lonneville and seconded by Councilwoman Smith, Supervisor Bender closed the meeting at 7:10pm.
