MARION ZONING BOARD OF APPEALS MINUTES

August 27, 2019

 

Time:  6:38pm.  Gregg Bell called the meeting to order.

 

Present:  Gregg Bell; John Lonneville, Martha Rich and Zachary Bartlett

Absent: Michael Hershelman, Daniel Sargent and Andrea Vandergrift

 

Also Present: Jonathan Ritter and Ronald Follett

 

6:39 pm – Gregg Bell announced that the voting members are Gregg Bell, John Lonneville, Martha Rich and Zachary Bartlett

 

6:40 pm – Gregg asked the board if they had any comments or questions regarding the previous meeting minutes. No comments.

 

Martha Rich made a motion to approve the minutes from June 25, 2019. Zachary Bartlett seconded the motion. All in favor.   None opposed.  Motion carried.

 

New Business:  Gregg Bell stated that there are two items on tonight’s agenda.

 

6:41pm – The first item is Application A-3-19:  Jonathan Ritter: Requesting a use variance to build a pole bard for storage of equipment on an Industrial zoned property on Kermway Drive.

6:42pm –The board came to the conclusion based on reading the Zoning Ordinance that they are not authorized to approve this application.

 

6:48pm –Gregg Bell opened the Public Hearing.

 

6:49pm –Gregg Bell closed the Public Hearing as there were no members of the public with any comments.

 

6:51pm –Martha Rich made a motion to write a letter recommending approval to the Code Enforcement Officer of Marion:

 

We recommend the Code Enforcement Office of Marion approves the application, as they are authorized to grant special condition permits. This is according to chapter 308 subsection 45H of the Town of Marion Zoning Law.

Zachary Bartlett seconded the motion. All in favor.   None opposed.  Motion carried.

 

6:41pm – Gregg Bell and the board completed/reviewed Section II of the SEAF which is on file in the applicant’s folder. Gregg Bell stated part III is N/A.

 

                Martha Rich made a motion to approve the SEAF as discussed. Zachary Bartlett seconded the motion. All in favor.   None opposed.  Motion carried.

 

6:51pm – The second item on the agenda is Application A-4-19:  Ronald Follett: Requesting an area variance to build a 40’ x 40’ pole barn in front of the primary residence at 5168 East Marion-Williamson Rd.

6:58pm –The board reviewed the neighbor notifications and had no questions.

 

                Martha Rich made a motion to approve the neighbor notification as discussed. John Lonneville seconded the motion. All in favor.   None opposed.  Motion carried.

 

7:00pm – Gregg Bell and the board completed/reviewed Section II of the SEAF which is on file in the applicant’s folder. Gregg Bell stated part III is N/A.

 

                Martha Rich made a motion to approve the SEAF as discussed. John Lonneville seconded the motion. All in favor.   None opposed.  Motion carried.

 

7:01pm – Gregg Bell and the board reviewed the Agricultural Data Statement, no significant findings or questions from the board.

 

                Martha Rich made a motion to approve the Agriculture Data statement. Zachary Bartlett seconded the motion. All in favor.   None opposed.  Motion carried.

 

7:02pm –Gregg Bell opened the Public Hearing.

 

7:03pm –Gregg Bell closed the Public Hearing as there were no members of the public with any comments.

 

7:04pm –Gregg Bell reviewed the Area Variance worksheet with the Board, completed worksheet is available in applicants folder.

 

7:07pm Gregg Bell asked the board if they had any additional questions of comments

 

7:08pm –Martha Rich moved to approve the Application A-4-19 to build a pole barn in front of the primary residence at 5168 East Marion-Williamson Rd. The pole barn will be situated at the center of the property, per the map presented by the applicant at the meeting.

7:09pm – Gregg Bell asked if there was any other questions or comment from the board. None at this time.

 

7:10pm – All approved. None opposed. Motion carried Application A-4-19 approved.

 

7:12pm – No old business

 

7:13pm – Martha Rich moved to adjourn the meeting.  John Lonneville seconded.  Meeting adjourned
