A Town board meeting of the Town of Marion, Wayne County, NY was held on

Monday, April 8, 2019 in the Marion Municipal Room.

 

Supervisor Deming called the meeting to order at 6:30pm.

Supervisor Deming called the meeting to order at 6:30pm and asked for a roll call.

Councilman Lonneville started the Pledge of Allegiance.

The Town Board went into Executive session at 6:30pm to discuss for potential litigation and returned to the regular meeting at 6:37pm.

Citizen Comments: 

None

Town Business:

Public Hearing – Comprehensive Plan – 6:45pm

Supervisor Deming opened the public meeting at 6:45pm and asked for public comments or concerns.  After three (3) request and no one asked any questions, the public hearing was closed at 6:46pm.

 

Supervisor Deming would like to look into LED street lighting.  Information from RG & E has been given to Town Board members to review.

 

Deputy Highway Superintendent, Steve Taber spoke regarding the Marion Town Park.  The Highway Department will be delivering two loads of sand and clay for the baseball fields later this week.  Steve Taber also mentioned that he will coordinator with Dana Luckman for a few loads of mulch to be delivered to the Town Park and Jennie’s House.  In the past, mulch has been a donation from Mr. Luckman.

Councilman Fisher spoke next regarding the need for fill under the play equipment at the Town Park.  Steve Taber will look into this and get this taken care of.

 

 

Committee Reports:

 

Supervisor Deming:  Water, Sewer, Town Clerk

Supervisor Deming asked if the Town Clerk’s office had anything new to report regarding the Town Clerk’s office that is not listed on the Town Clerk report.  Town Clerk, Heidi Levan stated everything is on the report.

Supervisor Deming asked Waste Water Treatment operator, Jeff Cragg to talk about a letter that needs to be signed.  Jeff explained the letter is to let the Department of Health know where the lab records for the Marion Waste Water Treatment plant will be stored.  Jeff then spoke about USG’s desire to monitor a local well. Jeff will continue to work the USG.  This project will not have any expenses for the Town of Marion.

Councilman Lonneville:  Deputy Supervisor, Historian, Zoning & Planning

Councilman Lonneville spoke about the Marion museum, Jennie’s House.  Code Enforcement Officer, Duane Smeatin has been busy drywalling the down starts, the goal is to have the lower level, hallway and stairs completed by May 1, 2019.

Councilman Lonneville asked Marion Historian, Caryn Devlin to speak next regarding the Marion Historian Association.  Caryn mentioned that a Genealogy presentation will take place on April 13th at the Marion library community room.  April 15th, The Board of Trustees will be having a meeting to review their bylaws and projects for 2019.  April 17th, the Wayne County Historian Association will be meeting at the Marion Library and then taking a tour of Jennie’s House.  May 4th, Mulch will be placed around Jennie’s House.  May 11th will be the Marion Organization Association, Spring Market in the parking lot next to Jennie’s House.

Councilwoman Smith:  Public Safety, Judicial, Library

Councilwoman Smith mentioned that the Marion Town Court heard 26 cases in the month of March.

Councilwoman Smith spoke next regarding the Marion Library.  The library has just completed their annual report to the community.  The library is now loaning ‘Empire Pass’ to patrons.  An Empire Pass allows you to enter NYS parks at no cost.   The library computer basics class is being rescheduled.  The back to the Marion library has now been repaired.

Councilwoman Fisher: Parks, Recreation, Assessor

Councilwoman Fisher reported that Leah Leno has been busy getting ready for Recreation Baseball to start.  Opening day of Baseball and Softball will be Saturday, April 27th at the Marion Town Park.  The Red Wings mascot will be attending this year.  Leah has also secured a Bounce House for opening day.

Councilwoman Fisher has a meeting scheduled with McKayla Gordon regarding the 2019 Summer Recreation program.

Councilwoman Fisher mentioned that the new Assessor, Dawn Van Patten has been doing a great job.  She also thanked Jeff Cragg and Duane Smeatin for moving Dawn’s office.

Debbie Wise who is currently a member of the Assessment Review Board has decided to resign.  Councilwoman Fisher has asked to have a resolution to advertise for a new Assessment Review Board member.

Councilman Bliek: Highway, Drainage

Councilman Bliek reported that the Highway Department has been doing an excellent job.  Easements are being done for Drainage issues on Mill Street.

Resolution #4032019 Authorize Surplus Equipment

The following resolution was adopted

 

 

WHEREAS, Steven Taber, Deputy Highway Superintendent, has recommended the Town of Marion surplus the following equipment:

 

  1. 1997 Ford Dump Truck with Front Plow and Wing – VIN#1FDZU90X2VVA27669

 

NOW BE IT RESOLVED, that the Marion Town Board accepts the recommendation to surplus the item as described above and authorizes the consignment to Roy Teitsworth, Inc. to be sold at the Municipal Auction in May 2019, Palmyra, NY;

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Steven Taber, Deputy Highway Superintendent and the Principal Account Clerk.

 

Resolution #4042019 Authorize Signing Western Regional Wastewater Project Control Agreement

 

This resolution was tabled.  Supervisor Deming would like to look into a few more things before bringing it back to the Town Board members to review and vote on.

 

BE IT RESOLVED, that the Marion Town Board hereby requests, pursuant to Public Authorities Law 1199-ee, that the Wayne County Water and Sewer Authority provide wastewater treatment and conveyance services for the benefit of the sewer users located in the Town of Marion, and all additional future sewer users and districts to be established with approval of the Town Board, to be connected to the sewer conveyance system and Western Regional Wastewater Treatment Plant to be constructed, owned and operated by Wayne County Water and Sewer Authority; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Town Clerk, Jeff Cragg and the Principal Account Clerk.

 

Resolution #4052019 Authorize Supervisor to Sign DASNY Grant Documents

BE IT RESOLVED, that the Marion Town Board authorizes, Heidi Levan, Town Clerk, to attend above mentioned NYS Association of Tax Receivers & Collectors training; and

BE IT FURTHUR RESOLVED, that the expenses incurred for registration, travel, lodging and meals will be paid by the Town of Marion and be appropriated from Account # 14104.01.000.016 at a cost not to exceed the amount of $760.00; and

BE IT FURTHUR RESOLVED, that the Town Board directs the Clerk of the Board to give a copy of this resolution to Heidi Levan, Town Clerk and the Principal Account Clerk.

Resolution #4082019 Authorize to Sign Letter to DOH for WWTP:

BE IT RESOLVED that the Marion Town Board authorizes Supervisor Deming to sign the NYS Department of Health regarding the Marion Waste Water Treatment Plant withdrawing from the ELAP program and;

BE IT RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Jeffrey Cragg, WWTP Operator and NYS Department of Health, Victoria Pretti.

Resolution #4102019 Authorize Transfer Funds from Contingent Account to Auditor

BE IT RESOLVED, that that Marion Town Board directs the Clerk of the Board to advertise the following in the legal newspaper for the Town of Marion

 

The Town of Marion is accepting letters of interest for the Board of Assessment Review. Letters may be directed to Supervisor, Nick Deming and will be accepted until April 22, 2019.  For further information contact Supervisor Nick Deming at 315-926-4145.
