A regular meeting of the Town Board of Marion, County of Wayne, in the State of New York, was held at the Marion Municipal Room, 3827 North Main Street, Marion, NY on the 14th day of November, 2016.

Supervisor Deyo called the meeting to order at 7:00pm.

Supervisor Deyo welcomed the students and encouraged them to ask questions.

Supervisor Deyo asked Councilman Fonte to lead us in the Pledge of Allegiance.

TOWN BUSINESS:

Councilman Lonneville thanked Jeff Cragg and Tim Boerman and his Highway Crew for cleaning up the leaves on Main Street today. He also talked about the NYS grant the Town has applied for. Peg Churchill of Wayne County Economic Development and Planning told Councilman Lonneville and Developer, Tom Salviski, about the grant. He thanked the many people who helped put the application together: Duane Smeatin, CEO; Debbie Smith, Town Clerk; Tina McQuillen, Town Assessor; Martha Rich, Zoning Board Chair; Fred Walker, Planning Board Chair; Don Bavis Superintendent of Marion Schools and Kim Jackson of M&T Bank, provided letters of commitment; Darrren and Jennifer Pynn, property owners, also joined in on the project; many hours were required by Cindy Ikewood, Account Audit Clerk, Virginia Mayville, Monica and myself in preparing the documents; the Town Board held special meetings and a Public Hearing. Amy DeAngelo, Wayne County Planning, helped us finalize the application to be submitted. We are hoping to get an answer in January, 2017. Councilman Lonneville explained the grant is to dress up the facade of vacant buildings on South Main Street (windows, doors, painting). Councilman Lonneville also commented on the joint meeting of the Marion Town Board and Marion School Board. In response to our request to move the school buses off Main Street, the school has an architect looking at other options. The Town is concerned about safety.

CITIZENS’ COMMENTS: Laura DeYoung, Marion resident, addressed the Board on behalf of herself and her husband. They would like to offer a rec volleyball program for grades 6 – 11 on Saturdays at the elementary school.

They are looking to start as soon as possible. Laura will try to work out schedule with Jody Phelps who currently offers the rec basketball program and talk to the school about using the facility. Supervisor Deyo stated the insurance company will want to know how many students and the ages. Laura will put the information together and send it to Virginia Mayville to put on the Town’s website.

COMMITTEE REPORTS:

Monica Deyo: Water, Sewer, Town Clerk: Regarding water, Supervisor Deyo stated the SE Water District is nearing completion with restoration to be completed in the spring if we run out of time. Jeff Cragg, Waste Water Treatment Plant Chief Operator, stated we are continuing to look for funding for the sewer project. Deborah Smith, Town Clerk, stated a resolution will follow hiring a Deputy Town Clerk, she just completed water and sewer collection for this quarter and hunting and fishing sales are slowing down.

Mike Fonte: Public Safety, Judicial, Library: Councilman Fonte stated he had nothing new to report. He will be contacting Brandon Martin regarding the steel plate on the sidewalk in front of the restaurant.
Regarding Public Safety, Supervisor Deyo stated Dr. Hannan has retired as Wayne County Coroner, but wishes to continue as our Health Officer.

Nathan Kauffman: Parks, Recreation, Assessor: Councilman Kauffman stated he continues to meet with Don Bavis, Marion CSD Superintendent, regarding the grant. He stated the grant is now being written and some additional items are being written into it to benefit the Town. Councilman Kauffman also stated he has met with Virginia Mayville regarding our current website. He stated our current host can update the website making it mobile friendly. Virginia Mayville will give figures to the Board to do a resolution for our host to do the updates. Councilman Kauffman has met with Tina McQuillen, Town Assessor regarding tax incentives. He has been in contact with the Association of Towns to see what we can do.

Ron Lonneville: Historian, Zoning, Planning: Councilman Lonneville thanked Carolyn Adriaansen for her fall pumpkin recipe presentation. He stated we are still waiting for funds from Nozzolio for repairs to Jennie’s House. Councilman Lonneville also thanked the Planning and Zoning members who attended the training session. He stated tomorrow there will be a training session to kick off the Comprehensive Plan.

LaVerne Bliek: Highway, Drainage: Councilman Bliek stated the North Main Street project is complete, except to tie in some drains. Nothing new for Drainage.

Tim Boerman, Highway Superintendent, stated on the Mill Street drainage project, they need to extend drain tile approximately 60’ to the ditch and he would like to get Red Creek cleaned out. The Highway trucks were all due for inspection in October so his crew was getting them ready for inspection and 4 out of the 5 trucks are ready to go, they helped the county with their project, hauled sand and mixed it with salt, , cleaned the shop, and installed some equipment on the playground at the park.

AUTHORIZE ADVERTISING FOR ALTERNATE ON THE ZONING BOARD OF APPEALS

On a motion by Councilman Bliek and seconded by Councilman Lonneville, the following resolution was

WHEREAS, a vacancy exist as alternate on the Zoning Board of Appeals; now

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to advertise the following in the legal newspaper for the Town of Marion:

The Town of Marion is accepting letters of interest for an Alternate on the Zoning Board of Appeals. Letters may be directed to Supervisor Monica Deyo and will be accepted until December 5, 2016. For further information contact Supervisor Monica Deyo @ (315) 926-4145.

RESOLUTION 110516
AUTHORIZE CONTRACT WITH WAYNE COUNTY PUBLIC WORKS-SNOW & ICE

On a motion by Councilman Bliek and seconded by Councilman Kauffman, the following resolution was

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the attached contract with Wayne County Public Works – Snow & Ice; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the County of Wayne, Marion Highway Superintendent, and the Account/Audit Clerk.

RESOLUTION 110616
DESIGNATE HEALTH INSURANCE POLICIES FOR 2016

On a motion by Councilman Lonneville and seconded by Councilman Fonte, the following resolution was

BE IT RESOLVED, that the Marion Town Board will offer the following Excellus policies to its’ full time eligible employees effective January 1, 2017;

5. Medicare Blue Choice Copay

AND BE IT RESOLVED, that the Marion Town Board will pay up to $1,000.00 per month for all eligible full time employees towards their health insurance/dental coverage; and

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign all necessary documents with Excellus; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Account/Audit Clerk.

AUTHORIZE HIRING SARAH MAYVILLE AS DEPUTY TOWN CLERK

On a motion by Councilman Bliek and seconded by Councilman Lonneville, the following resolution was put to a vote by roll call which resulted in the following:

WHEREAS, a vacancy exists in the Town Clerk’s Office; and

WHEREAS, Deborah Smith, Town Clerk, has recommended hiring Sarah Mayville; now

BE IT RESOLVED, that the Town Board accepts the recommendation of Deborah Smith and authorizes hiring Sarah Mayville, 4859 Smith Road, Marion, effective December 5, 2016 (PT Probationary 6 months) at remuneration of $13.00 per hour up to 23 hours per week of which 19 hours per week be appropriated from Account # 14101.1.0.036, 2 hours per week be appropriated from Account# 83101.6.0.000 and 2 hours per week be appropriated from Account # 81101.7.0.00; and

BE IT RESOLVED, that as the Town Clerk deems necessary, Sarah be allowed to work additional hours, not to exceed 34 hours per week to be appropriated from Account # 14101.1.0.036; and

BE IT FURTHER RESOLVED, that the Marion Town board directs the clerk of the Board to give a copy of this resolution to Sarah Mayville and the Account Clerk.

BE IT RESOLVED, that the Marion Town Board authorizes hiring Caryn Devlin, 4050 Evergreen Street, Marion, as Town Historian (PT) effective January 1, 2017 at remuneration of $2000.00 year; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Caryn Devlin and the Account/Audit Clerk.

BE IT RESOLVED, that the Marion Town Board authorizes hiring Kathleen Cauwels, 139 Stafford Street, Palmyra, as Principal Account Clerk effective December 5, 2016 at remuneration of $19.00 per hour for 35 hours per week (Full Time 35 hours/week; Probationary 6 months) to be appropriated from account 12201.1.0.021; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Kathleen Cauwels and the Account/Audit Clerk.

RESOLUTION 111016
ACCEPT SOUTHEAST WATER PROJECT AS CONSTRUCTED SUBJECT TO COMPLETION OF PUNCH LIST

On a motion by Councilman Lonneville and seconded by Councilman Fonte, the following resolution was
ADOPTED: Ayes: 5 Bliek, Fonte, Kauffman, Lonneville, Deyo
Nays: 0

Whereas, the construction of the improvements for the Town Marion South East Water District Project have been completed and approved by the NYS Department of Health; and

Now, therefore be it resolved, that the Town of Marion accepts the project as constructed, subject to completion of the punch list items as identified by the Project Engineer.

Be it further resolved that a NYS certified operator, Daniel G. Demay (NYSDOH Certificate #NY0035770), will operate the water system pursuant to the Agreement between the Town of Marion and the Wayne County Water and Sewer Authority.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Kathy Dear @ LaBella, Cynthia Newcomb @ USDA, and the Account/Audit Clerk.

RESOLUTION 111116
SOUTHEAST WATER DISTRICT BUDGET MODIFICATION

On a motion by Councilman Lonneville and seconded by Councilman Fonte, the following resolution was
ADOPTED: Ayes: 5 Bliek, Fonte, Kauffman, Lonneville, Deyo
Nays: 0

WHEREAS, the Town of Marion developed the budget for the Southeast Water District project based on an estimate for the Net Interest Expenses; and

WHEREAS, the actual costs for the Net Interest Expense will be more than the budgeted amounts; now

BE IT RESOLVED that the Town Board hereby authorizes an increase of $7,130 in the budget for the Net Interest Expense, from $12,870 to $20,000, with a corresponding decrease in the Contingency; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Kathy Dear @ LaBella, Cynthia Newcomb @ USDA, and the Account/Audit Clerk.

Supervisor Deyo recessed the meeting for the Board to review the claims at 8:00pm. The meeting reconvened at 8:22pm.

On a motion by Councilman Kauffman and seconded by Councilman Fonte, the following resolution was
