A regular meeting of the Town Board of Marion, County of Wayne, in the State of New York, was held at the Marion Municipal Room, 3827 North Main Street, Marion, NY on the 10th day of October, 2016.

Supervisor Deyo called the meeting to order at 7:07pm.

ABSENT:

Others in Attendance: Tim Boerman, Highway Superintendent;
Jeff Cragg, Waste Water Treatment Plant Operator; Perry Howland, reporter for the Sun and Record and Madison Moore, Rebekah Hilton, Taylor Thomas and Gabrielle Ritzmann, par-gov students.

Supervisor Deyo asked Councilman Fonte to lead us in the Pledge of Allegiance.

TOWN BUSINESS:

Councilman Lonneville stated the parking lot sidewalk will be poured tomorrow. There will be a new sign going up to direct traffic in and out of the parking lot. There will be no parking in front of the parking lot. Councilman Lonneville also stated he is looking forward to a joint meeting with the Marion School Board. Lonneville will be putting on a presentation on Marion’s vision. Supervisor Deyo stated no time has been set yet.

Councilman Kauffman stated he had a meeting with the School Superintendent, Don Bavis regarding the grant opportunity for the Town and School. They discussed criteria. It is a very competitive grant, but Councilman Kauffman stated we are more eligible than we were before. It is a 5 year plan. Councilman Kauffman also stated he will be meeting with Virginia Mayville to look over layouts for our website. He will also be meeting with Tina McQuillen.

CITIZENS’ COMMENTS: None

COMMITTEE REPORTS:

Monica Deyo: Water, Sewer, Town Clerk: Supervisor Deyo said the WCWSA is doing a great job finishing up the driveway work on the SE water district. Regarding sewer, we are still meeting regarding the sewer project. This will be ongoing. Jeff Cragg stated they passed state deficiency test for the Health Dept.
The Town Clerk is interviewing for the Deputy Clerk position and is busy with dog and hunting/fishing licensing and water/sewer bill collection.

Mike Fonte: Public Safety, Judicial, Library: Nothing new to report for Judicial or Library. Regarding Public Safety, Councilman Fonte stated we are looking into revising our Property Nuisance Abatement law. He is collecting copies of ordinances from other towns for the Board to review. Supervisor Deyo asked him about the metal plates in the sidewalk in front of the restaurant. Councilman Fonte stated, Brandon Martin, owner of the restaurant is going to take care of it.

Nathan Kauffman: Parks, Recreation, Assessor: Reported under Town Business. Supervisor Deyo stated after the first of the new year, we will have to advertise for a new Rec Director, Park Supervisor and Baseball/Soccer coordinator for next year.

Ron Lonneville: Historian, Zoning, Planning: Councilman Lonneville reported we are getting quotes for chimney, electric and plumbing for Jennie’s House. Carolyn Adriaansen, Town Historian, is having a presentation this month “Pumpkin Recipes”. Regarding Zoning and Planning, he thanked members for attending the recent training. Councilman Lonneville also stated Duane Smeatin, Code Enforcement Office, is attending training 3 days this week.

LaVerne Bliek: Highway, Drainage: Nothing on Drainage. Tim Boerman, Highway Superintendent, reported the Highway Department helped Macedon and Ontario with paving, they fixed open road and driveway cuts, oiled/stoned and swept Cambier Road, backfilled around curbs, put up and took down banner for Fall Festival, mowed roadsides/Jennie’s House and park. He also stated the County will start grinding North Main Street next week and then will pave the road. He has only received one complaint regarding the project.

AUTHORIZE APPROPRIATION FROM RESERVE

On a motion by Councilman Lonneville and seconded by Councilman Bliek, the following resolution was

WHEREAS, the Marion Town Board duly held a public hearing on October 10, 2016 @ 7:00 PM for the purpose of authorizing an appropriation from R11-230 in an amount not to exceed $24,229.56 for the purpose of purchasing a pickup truck; now

BE IT RESOLVED, that the Marion Town Board authorizes the appropriation from R11-230 in an amount not to exceed $24,229.56 for the purpose of purchasing a pickup truck; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Account/Audit Clerk and Chief Operator WWTP.

AUTHORIZE PURCHASE OF PICK-UP TRUCK

On a motion by Councilman Bliek and seconded by Councilman Fonte, the following resolution was

BE IT RESOLVED, that the Marion Town Board authorizes the Chief Operator of the WWTP to purchase a 2017 Ford Pickup Truck from VanBortel in an amount of $32,277.22 (which includes the trade in of the WWTP truck 2003 F350) per attached quote #22782; and

BE IT RESOLVED, that the Marion Town Board amends the 2016 budget as follows:

RESOLUTION 100516
AMEND SEWER ORDINANCE

On a motion by Councilman Lonneville and seconded by Councilman Kauffman, the following resolution was
ADOPTED: Ayes: 5 Bliek, Fonte, Kauffman, Lonneville, Deyo
Nays: 0

WHEREAS, Jeff Cragg, Chief Operator WWTP has recommended a change of fees and charges now being imposed for providing sewer services within the Town of Marion Sewer District; and

WHEREAS, a notice has been given as prescribed by law of a public hearing; and

WHEREAS, a public hearing was held on October 10, 2016 at 7:00 PM, and due consideration has been given to the issue; now

BE IT RESOLVED, that pursuant to 452 of the General Municipal Law, the Sewer Ordinance is amended to provide for sewer charges as follows effective January 1, 2017:

$42.00 = per Sewer Unit Charge
$17.00 = Minimum Charge for first 3,000 gallons
$ 4.05 = per thousand gallons thereafter as metered; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the WCW&SA and the Chief Operator of the WWTP.

WHEREAS, a vacancy will exist for Town Historian on January 1, 2017; now

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to advertise the following in the legal newspaper for the Town of Marion:

The Town of Marion is accepting applications for the position of Town Historian effective January 1, 2017. Applications may be picked up at the Marion Town Clerk’s office during normal business hours. Applications will be accepted until November 7, 2016. On a motion by Councilman Lonneville and seconded by Councilman Fonte, the following resolution was duly put to a vote on roll call which resulted in the following:

BE IT RESOLVED, that the Marion Town Board authorizes remuneration at $22.00 per hour for 20 hours per week retroactive to June 14, 2016; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Duane F. Smeatin, and the Account/Audit Clerk.

Whereas, the Tentative Budget has been reviewed by the Marion Town Board,

BE IT RESOLVED, that the Marion Town Board approves the Tentative Budget for 2017 which now becomes the Preliminary Budget.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to advertise the following in the legal newspaper for the Town of Marion:

NOTICE IS HEREBY GIVEN that the Preliminary budget for the Town of Marion, New York, for the fiscal year beginning January 1, 2017 has been completed and filed in the Town Clerk’s Office of the Town of Marion, where it is available for inspection by any interested persons at all reasonable hours; and

FURTHER NOTICE IS GIVEN that the Town Board of the Town of Marion will meet and review said budget and hold a Public Hearing on November 7, 2016 @ 5:00 PM at the Marion Municipal Room, 3825 N. Main Street, Marion, New York, at which time and place any persons may be heard in favor or against any items therein contained; and
