A regular meeting of the Town Board of Marion, County of Wayne, in the State of New York, was held at the Marion Municipal Room, 3827 North Main Street, Marion, NY on the 13th day of June, 2016.

Supervisor Deyo called the meeting to order at 7:02pm.

ABSENT:

Others in Attendance: Tim Boerman, Highway Superintendent; and Jeff Cragg, Waste Water Treatment Plant Operator; Gary Lau, Code Enforcement Office; Becky Block, reporter for the Times of Wayne County; Perry Howland, reporter for the Sun and Record.

Supervisor Deyo asked Councilman Fonte to lead us in the Pledge of Allegiance.

TOWN BUSINESS: The Board discussed the turning on and off of the electric at the Town Park.

CITIZENS’ COMMENTS: None

COMMITTEE REPORTS:

Monica Deyo: Water, Sewer, Town Clerk: Supervisor Deyo is meeting with the WCWSA for update on SE project and the regional water tank for the NE corner of Marion.
Supervisor Deyo stated she was worried about the transition to a new sewer plant while Jeff Cragg, WWTP chief operator, and Virginia Mayville, operator, are training for the new system. Jeff stated that the WWTP operator from Ontario is willing to help Marion out during that transition for the minimum of the required 2 hours per day.
Nothing new in the Town Clerk’s Office. Issuing dog licenses and marriage licenses is ongoing.

Mike Fonte: Public Safety, Judicial, Library: Nothing on Safety/Judicial. Councilman Lonneville asked if Brandon Martin has been contacted about the steel plates on Main Street and stated we need to get that taken care of. Councilman Fonte stated he has left a message for Tracy Whitney, Library Director, regarding the tapestry.

Nathan Kauffman: Parks, Recreation, Assessor: Nothing for Assessor.
Councilman Kauffman stated Steve Schutt is going to send the Town a draft of the new sign for the Park rules. Supervisor Deyo stated she has received it. The estimate is $1,000.00. Councilman Kauffman stated he had some ideas about lighting the sign.

Ron Lonneville: Historian, Zoning, Planning: Councilman Lonneville thanked Gary, Jeff, Tim and his crew for working on the drainage at Jennie’s House. Jeff and Gary did the raking and seeding. Councilman Lonneville also thanked his son, John, for helping me get the mulch in and Dana Luckman for donating a load of mulch. Martha and Carolyn had the museum open Memorial Day. He is going to meet with Martha to develop a budget for 2017. Councilman Lonneville is working on getting quotes for taking down the evergreen tree at Jennie’s house.
For Planning/Zoning, Councilman Lonneville attended a NYS training session which was very informative. He has a lot of information to share. He has informed Fred Walker, Planning Board Chair and Martha Rich, Zoning Board Chair, that Board members need to get training as there are a lot of regulations that they need to get up to date on. We need to fill the vacant position on the Board of Assessment Review Board. As far as commercial and industrial properties, Tom Salviski has closed on two town properties and hoping to close on the third one soon. Tom is looking for viable businesses and is re-doing Mark’s.
The Board is hiring Duane Smeatin as part-time Code Enforcement officer (20 hours per week). We are working on putting together a Comprehensive Plan Team. Will get the team presented to the Board next Board meeting.

LaVerne Bliek: Highway, Drainage: No report on drainage. Committee is looking into filling in ditch behind the houses on North Main.
Tim Boerman, Highway Superintendent of Highways, reported they finished stripping trucks and painting them, worked on dugouts with Gary, got the road tractor ready, did some spring cleaning, spruced up downtown, hung flowers, did some mowing. Tim will order municipal parking signs from the county sign department.
Supervisor Deyo stated we need to find someone to put up and take down the flags on Main Street.

AMEND RESOLUTION #021516 (RESIGNATION OF CODE ENFORCEMENT OFFICER)

On a motion by Councilman Lonneville and seconded by Councilman Kauffman, the following resolution was

BE IT RESOLVED, that the Marion Town Board amends resolution #021516 to reflect a resignation date of 06/29/2016; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Gary Lau and the Account/Audit Clerk.

AUTHORIZE HIRING PT CODE ENFORCEMENT OFFICER

On a motion by Councilman Lonneville and seconded by Councilman Kauffman, the following resolution was put to a vote which resulted in the following:

The resolution was declared duly adopted.

BE IT RESOLVED, that the Marion Town Board authorizes hiring Duane F. Smeatin, 2889 Schilling Road, Marion New York as a PT (provisional, non-competitive) Code Enforcement Officer effective 06/14/2016; and

BE IT RESOLVED, that said appointment is contingent on passing the 2017 Code Enforcement Civil Service Exam; and

BE IT RESOLVED, that Duane F. Smeatin be reimbursed $25.00 per month for cell phone use to be vouchered in July and at the end of December annually; and

BE IT RESOLVED, that the Marion Town Board authorizes remuneration at $19.23 per hour for 20 hours per week (Employee/Town Board to agree upon 20 hour work schedule) and (employee to prepare time card manually); and use of CEO truck as stipulated by hiring contract agreement.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Duane F. Smeatin, and the Account/Audit Clerk.

AUTHORIZE APPROPRIATION FROM RESERVE

On a motion by Councilman Lonneville and seconded by Councilman Fonte, the following resolution was put to a vote which resulted in the following:

WHEREAS, the Marion Town Board duly held a public hearing on June 13, 2016 @ 7:00 PM for the purpose of authorizing an appropriation of an amount up to $30,000.00 from the Highway Equipment Reserve R7 for the purpose of purchasing a 2016 Cat Loader; now

BE IT RESOLVED, that the Marion Town Board authorizes the appropriation of up to $30,000.00 from Highway Equipment Reserve R7 for a 2016 Cat Loader; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Account/Audit Clerk and the Highway Superintendent.

AUTHORIZE AMENDMENT TO RESOLUTION #061015-N. MAIN STREET WATER

On a motion by Councilman Bliek and seconded by Councilman Fonte, the following resolution was

BE IT RESOLVED, the Marion Town Board approves Amendment No.1 to the Agreement for Professional Services in the amount of $2,180.50 for MRB Group as attached (N. Main Street Water); and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to MRB Group and the Account/Audit Clerk.

RESOLUTION 060716
RE-APPOINT HEALTH OFFICER

On a motion by Councilman Bliek and seconded by Councilman Lonneville, the following resolution was
ADOPTED: Ayes: 5 Bliek, Fonte, Kauffman, Lonneville, Deyo
Nays: 0

WHEREAS, the term of the Health Officer of the Town of Marion expires on 06/01/16; and

WHEREAS, Dr. David T. Hannan, PO Box 173, Pultneyville, NY 14538, has indicated that he will accept another term as Health Officer; now

BE IT RESOLVED, that the Marion Town Board hereby appoints Dr. David T. Hannan, PO Box 173, Pultneyville, NY 14538, to a four year term effective 06/01/16 thru 06/01/20 at remuneration of $1,045.50 annually; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to NYSDOH, Dr. David T. Hannan, the Code Enforcement Officer, and the Account/Audit Clerk.

RESOLUTION 060816
AUTHORIZE REFUND OF RENTAL FEE

On a motion by Councilman Kauffman and seconded by Councilman Lonneville the following resolution was
ADOPTED: Ayes: 5 Bliek, Fonte, Kauffman, Lonneville, Deyo
Nays: 0

WHEREAS, Kitty Goodridge rented Pavilion C in the Marion Town Park on Saturday, June 11, and

WHEREAS, the electric was not on to the pavilion,

BE IT RESOLVED, that the Marion Town Board authorizes refunding the rental fee of $40.00 to Kitty Goodridge of 3706 South Main Street, Marion, to be appropriated from Account A2001, and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Kitty Goodridge and the Account Clerk.

Supervisor Deyo recessed the meeting for the Board to review the claims at 8:20pm. The meeting reconvened at 8:47pm.

PAYMENT OF CLAIMS

On a motion by Councilman Lonneville and seconded by Councilman Kauffman, the following resolution was
ADOPTED: Ayes: 5 Bliek, Fonte, Kauffman, Lonneville, Deyo

WHEREAS, the Marion Town Board has received and audited the following claims; now
BE IT RESOLVED, that the Supervisor is hereby authorized to pay said claims upon receipt of the signed abstracts of audited claims from the Town Clerk.
