A regular meeting of the Town Board of Marion, County of Wayne, in the State of New York, was held at the Marion Municipal Room, 3827 North Main Street, Marion, NY on the 9th day of May, 2016.

Supervisor Deyo called the meeting to order at 7:00pm.

Laverne Bliek, Councilman
Michael Fonte, Councilman
Ronald Lonneville, Councilman

ABSENT: Nathan Kauffman, Councilman

Others in Attendance: Tim Boerman, Highway Superintendent; and Jeff Cragg, Waste Water Treatment Plant Operator and 8 par-gov students.
Supervisor Deyo asked Councilman Fonte to lead us in the Pledge of Allegiance.

TOWN BUSINESS: Supervisor Deyo welcomed the students and encouraged them to ask questions or comment on anything.

CITIZENS’ COMMENTS: None

COMMITTEE REPORTS:

Monica Deyo: Water, Sewer, Town Clerk: Regarding water, Supervisor Deyo stated we are starting the new water district on Reeves Road. This is the last water line and all of Marion will have access to public water. This is the largest district we’ve done – 51,000 linear feet of water line. Regarding sewer – the Marion Town Board met with the Walworth Town Board to see what they can do for us as far as us pumping our waste water to Walworth. The Marion Town Board has not made a decision yet.
Jeff Cragg, Waste Water Treatment Plant Operator, stated they just went through a state health department inspection and only had 2 deficiencies.

Mike Fonte: Public Safety, Judicial, Library: Nothing new for Judicial. Councilman Fonte stated that painting is being done in the lower level of the Library. Councilman Fonte is concerned about the steel plate in the sidewalk in front of the restaurant. We need to contact the owner to get this resolved.

Nathan Kauffman: Parks, Recreation, Assessor: Absent. Tim Boerman and his crew got the baseball fields ready. Mackenzie Reiss is our head programmer again this year and has scheduled sign-ups for summer rec. Baseball is underway four nights a week.

Ron Lonneville: Historian, Zoning, Planning: Carolyn Adriaansen, Town Historian, and Martha Rich have met and are beginning to get things inventoried and cataloged. The Town and Gary Lau will be running a drainage pipe to the storm sewer from the downspouts on Jennie’s house.
Councilman Lonneville thanked Gary Lau for fixing the front door lock and the lights upstairs at Jennie’s house. There is a situation at the Boerman house on the Walworth Road and Councilman Lonneville will be talking with Peg Churchill about that project. The owner of the former drug store is beginning to clean that property up.

LaVerne Bliek: Highway, Drainage: Regarding drainage, Councilman Bliek stated they are looking into the ditch by the old cold storage building. They are also working on the swamp between Franklin and East Williamson Roads.
Tim Boerman, Highway Superintendent, reported he and his crew hauled clay and sand for the baseball diamonds, rolled and started mowing the park. They swept roads – they went out 5 times due to storms, had a Ginna training, serviced the mow tractor, painted plow equipment, replaced culvert and took the tree out by the elementary school.

AUTHORIZE STATE ASSISTANCE FOR A REASSESSMENT PROJECT FOR TOWN OF MARION

On a motion by Councilman Fonte and seconded by Councilman Bliek, the following resolution was
ADOPTED: Ayes: 4 Bliek, Fonte, Lonneville, Deyo
Nays: 0

WHEREAS, the Town of Marion has undergone the revaluation of real properties within the Town, the Town feels that it is necessary to conduct a reassessment project of all properties for the 2017 assessment roll to maintain a uniform standard of assessment for the town; now

THEREFORE BE IT RESOLVED, by the Town Board of the Town of Marion, New York, that the Town of Marion hereby requests State assistance, specifically from the NYS Office of Real Property Services, to help do a reassessment project to maintain a uniform standard of assessment in accordance with Section 305 of the Real Property Tax law; and

IT IS FURTHER RESOLVED, that the Supervisor is hereby authorized and directed to expend the necessary funds for the preparation of said plan and the establishment and maintenance of the Real Property Improvement Program; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Town Assessor, Wayne County Real Property Tax, and New York State Office of Real Property Services.

ADOPT BUDGET FOR SOUTHEAST WATER DISTRICT
On a motion by Councilman Bliek and seconded by Councilman Fonte, the following resolution was

BE IT RESOLVED, that the Marion Town Board adopts the attached budget for the Southeast Water District;

AND BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Account/Audit Clerk.

EMS WEEK PROCLAMATION

On a motion by Councilman Lonneville and seconded by Councilman Fonte, the following resolution was

WHEREAS, emergency medical services is a vital public service; and

WHEREAS, the members of emergency medical services teams are ready to provide lifesaving care to those in need 24 hours a day, seven days a week; and

WHEREAS, access to quality emergency care dramatically improves the survival and recovery rate of those who experience sudden illness or injury; and

WHEREAS, the emergency medical system consists of first responders, emergency medical technicians, paramedics, firefighters, educators, administrators, emergency nurses, emergency physicians, and others; and

WHEREAS, the members of emergency medical services teams, whether career or volunteer, engage in thousands of hours of specialized training and continuing education to enhance their lifesaving skills; and

WHEREAS, it is appropriate to recognize the value and the accomplishments of emergency medical services providers by designating Emergency Medical Services Week; now

THEREFORE, I, Monica Deyo, in recognition of this event, do hereby proclaim the week of May 15-21 2016, as

with the theme “EMS STRONG”, I encourage the community to observe this week with appropriate programs, ceremonies and activities.

RESOLUTION 050716
AUTHORIZE PUBLIC HEARING FOR APPROPRIATION FROM HIGHWAY EQUIPMENT RESERVE
On a motion by Councilman Bliek and seconded by Councilman Lonneville, the following resolution was

BE IT RESOLVED, that the Marion Town Board authorizes the Clerk of the Board to advertise in the legal newspaper for the Town of Marion that a Public Hearing will be held on June 13, 2016 @ 7:00 PM, at the Marion Municipal Room for the purpose of authorizing the appropriation of an amount up to $30,000.00 from the Highway Equipment Reserve R7 for the purpose of purchasing a 2016 Cat Loader.

AGREEMENT TO SPEND HIGHWAY FUNDS 2016

On a motion by Councilman Bliek and seconded by Councilman Lonneville the following resolution was

WHEREAS, Tim Boerman, Highway Superintendent, has prepared an Agreement to Spend Town Highway Funds for 2016; now

BE IT RESOLVED, that the Marion Town Board accepts and approves the attached Agreement to Spend Town Highway Funds for 2016 and authorizes all members of the Town Board and Town Highway Superintendent to sign said agreement in duplicate and then forward such to the County Superintendent of Highways for his signature; and

BE IT FURTHER RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Highway Superintendent and the Account/Audit Clerk.

ACCEPT QUOTE FOR PORT-A-JON RENTAL AGREEMENT WITH BREWER’S SEPTIC SERVICES, AS AMENDED

On a motion by Councilman Bliek and seconded by Councilman Fonte, the following resolution was

BE IT RESOLVED, that the Marion Town Board approves the attached quote with Brewer’s Septic Services, Inc. as amended for 2 Units @ $290.00/month and authorizes the Supervisor to sign said agreement.

DESIGNATE WILLIAMSON TOWN BOARD AS LEAD AGENCY FOR ENVIRONMENTAL REVIEW

On a motion by Councilman Bliek and seconded by Councilman Fonte, the following resolution was
ADOPTED: Ayes: 4 Bliek, Fonte, Lonneville, Deyo
Nays: 0

BE IT RESOLVED, that the Marion Town Board designates the Williamson Town Board as Lead Agency for Environmental Review and determination of significance for an update to the Town of Williamson Zoning Ordinance; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Supervisor of the Town of Williamson.

ACCEPT AGREEMENT FROM POTTER HVAC & METAL FAB, INC.

On a motion by Councilman Lonneville and seconded by Councilman Fonte, the following resolution was

BE IT RESOLVED, that the Marion Town Board accepts the attached agreement from Potter HVAC & Metal Fab, Inc., PO Box 396, Canandaigua, NY 14424, for the WWTP for the term of one year effective 4/11/16-4/11/17 in the amount of $195.00 to be appropriated from 81304.7.0.168; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to HVAC & Metal Fab, Inc., and the WWTP Chief Operator.

RESOLUTION 051216
AUTHORIZE HIGHWAY SUPERINTENDENT TO MAKE MODIFICATIONS TO 3849 NORTH MAIN STREET OFF-STREET PARKING LOT

On a motion by Councilman Lonneville and seconded by Councilman Fonte, the following resolution was
ADOPTED: Ayes: 4 Bliek, Fonte, Lonneville, Deyo
Nays: 0

WHEREAS, the Marion Town Board is interested in finishing the off-street parking lot located at 3849 North Main Street; now

BE IT RESOLVED, that the Marion Town Board authorizes, (contingent upon verification of easements), Marion Highway Superintendent to:
1. Install new curb
2. Install new sidewalk as a result of installing new curb
3. Install signs indicating “Public Parking”

AND BE IT RESOLVED, that all costs incurred be charged to account 56504.1.0 “Off Street Parking”; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Marion Highway Superintendent, Wayne County Highway Department, and the Account/Audit Clerk.

Supervisor Deyo recessed the meeting for the Board to review the claims at 8:10pm. The meeting reconvened at 8:40pm.

PAYMENT OF CLAIMS

On a motion by Councilman Fonte and seconded by Councilman Lonneville, the following resolution was

WHEREAS, the Marion Town Board has received and audited the following claims; now
BE IT RESOLVED, that the Supervisor is hereby authorized to pay said claims upon receipt of the signed abstracts of audited claims from the Town Clerk.
