A regular meeting of the Town Board of Marion, County of Wayne, in the State of New York, was held at the Marion Municipal Room, 3827 North Main Street, Marion, NY on the 11th day of April, 2016.

Supervisor Deyo called the meeting to order at 7:00pm.

ABSENT:

Others in Attendance: Don Bavis, Marion Central School Superintendent; Perry Howland, reporter for the Sun & Record; Jeff Cragg, Waste Water Treatment Plant Operator; Tim Boerman, Highway Superintendent; Gary Lau, Code Enforcement Officer, and 8 par gov students.

Supervisor Deyo asked Councilman Fonte to lead us in the Pledge of Allegiance.

TOWN BUSINESS: Discussion ensued regarding our waste water going to Walworth for treatment. The Board discussed the three options as a result of the feasibility study:
A) replacing existing WWTP with SBR facility at an estimated cost of $6,100,000.00
B) Replace existing WWTP with new SAGR facility at an estimated cost of $5,030,000.00
C) Consolidate WWTP with Town of Walworth at an estimated cost $4,768,500
Jeff Cragg, Waste Water Treatment Plant Operator, stated the violation letter proposed new stringent limits. SBR system could meet those limits. Disinfection could be added to it. The SAGR facility would still use our lagoons with an additional cost if disinfection is added. Walworth has SBR can handle stringent permit limits. Supervisor Deyo stated the plant we currently have is not really made for this climate.
If we turn over the WWTP to Walworth, we lose complete control. No decision has been made yet.

CITIZENS’ COMMENTS: Don Bavis, Marion Central School Superintendent, attended the meeting to introduce himself. He thanked the Town for taking the tree down by the Elementary School. He stated he is on board with anything the Town wanted to do cooperatively.

COMMITTEE REPORTS:

Monica Deyo: Water, Sewer, Town Clerk: Supervisor Deyo stated she has been to a couple of meetings regarding a regional water storage tank with Ontario, Williamson, Arcadia, Sodus and Marion. Each town would pay proportionately. The Wayne County Water and Sewer Authority would manage it.

Mike Fonte: Public Safety, Judicial, Library: Councilman Fonte had nothing to report for Judicial or Library. For Public Safety, he passed out diagrams for suggested parking layout of parking lot on Main Street between the elementary school and the businesses. Supervisor Deyo stated the Library Director is working on painting.

Nathan Kauffman: Parks, Recreation, Assessor: Councilman Kauffman reported that we need to make a decision about the park rules for the park. Once we give the go ahead, it will take 2 – 3 weeks.

Ron Lonneville: Historian, Zoning, Planning: Councilman Lonneville reported that he has met with Carolyn Adriaansen, Town Historian. She will be moving items from her house to the upstairs of the Town Hall. Councilman Lonneville stated John Lonneville is interested in helping inventory and cataloging items. He stated the side porch is complete and he talked about future plans for Jennie’s House. He passed out a quote for the business directory signs. Councilman Lonneville stated he will be attending the Zoning Board workshop on Wednesday and is continuing to work with commercial developers. He also stated we need to start interviewing for Gary Lau’s position; he would like to have someone hired by June 1 so that the new Code Enforcement Office can shadow Gary. He also stated we need to have a list of projects for the Mormons by May 1.

LaVerne Bliek: Highway, Drainage: Councilman Bliek reported they are cleaning out north end of Red Creek.

Tim Boerman, Highway Superintendent, reported his crew plowed 3 times; they did repairs, cleaned trucks, did ditching and cleaned culverts, hauled sand, changed 2 signs and swept roads.

AUTHORIZE 2016 MOWING AGREEMENT WITH COUNTY OF WAYNE

On a motion by Councilman Bliek and seconded by Councilman Fonte, the following resolution was

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the attached Mowing Agreement with the County of Wayne; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Office of the Wayne County Attorney, Highway Superintendent, and the Account/Audit Clerk.

AUTHORIZE RONALD LONNEVILLE TO ATTEND SPRING LOCAL GOVERNMENT WORKSHOP

On a motion by Councilman Bliek and seconded by Councilman Kauffman, the following resolution was

BE IT RESOLVED, that the Marion Town Board authorizes Ronald Lonneville, Town Councilman, to attend the Spring Local Government Workshop to be held on May 19, 2016 in Pittsford, New York; and

BE IT RESOLVED, that all associated cost for the workshop be reimbursed from account 10104.1.0.004; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Ronald Lonneville, and the Account/Audit Clerk.

AUTHORIZE HIRING 2016 CONCESSION STAND OPERATOR

BE IT RESOLVED, that the Marion Town Board authorizes hiring Sarra Osborn, 4230 Greenfield Drive, Marion, NY, as the 2016 Concession Stand Operator at remuneration of $1,500.00 for the season to be appropriated from account 73104.1.0.085 effective (05/02/2016-08/19/2016, 16 weeks); and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Sarra Osborn, and the Account/Audit Clerk.

AUTHORIZE ADDITIONAL FAX LINE AT TOWN COURT
On a motion by Councilman Bliek and seconded by Councilman Lonneville, the following resolution was

WHEREAS, the Marion Town Court has requested a fax line be installed; now

BE IT RESOLVED, that the Marion Town Board authorizes a fax line be installed for the Marion Town Court; and
BE IT RESOLVED, that all expenses be charged to the 2016 Court Budget; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Marion Court Clerk and the Account/Audit Clerk.

RESOLUTION 040716
AWARD OF CONTRACT TO WAYNE COUNTY WATER AND SEWER AUTHORITY FOR CONSTRUCTION OF MARION SOUTHEAST WATER DISTRICT
On a motion by Councilman Lonneville and seconded by Councilman Fonte, the following resolution was duly put to a vote by roll which resulted in the following:

WHEREAS, USDA-Rural Development-Rural Utility Service (RUS) has approved the construction of the Marion Southeast Water District Improvements, (the “Project”), by the Wayne County Water and Sewer Authority (“WCWSA”) in accordance with the design plans submitted by the Project Engineer (MRB Group); and
WHEREAS, said Project Engineer has reviewed the Itemized Proposal (“Proposal”) submitted by WCWSA in conjunction with the Project budget, and has recommended that adequate funds are available to construct the Project based on the Proposal; and
WHEREAS, said Project Engineer has prepared and submitted a Notice of Award to be executed by the Town of Marion and the WCWSA.
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Marion, Wayne County, New York as follows:
Section 1. The Town Board hereby awards the Contract for construction of the Project to the WCWSA for the Total Base Bid plus Conditional Items at a cost of $1,502,980.00.
Section 2. The Supervisor of the Town of Marion is hereby authorized to execute the Notice of Award and the formal Construction Agreement for the construction of the aforesaid water distribution system and related appurtenances

RESOLUTION 040816
APPROVE CHANGE ORDER SUBMITTED BY KNATAITIS FOR MUSEUM SIDE PORCH

On a motion by Councilman Bliek and seconded by Councilman Lonneville, the following resolution was
ADOPTED: Ayes: 5 Bliek, Fonte, Kauffman, Lonneville, Deyo
Nays: 0

WHEREAS, per resolution 122415 the Marion Town Board authorized Knataitis, 7525 Bear Swamp Road, Williamson, to replace the side porch at the Museum (Jenny’s House) at a cost of $27,824.00;and

WHEREAS, Knataitis has requested a change order in the amount of $1,203.00 for a basement window and repointing the foundation behind the existing porch; now

BE IT RESOLVED, that the Marion Town Board approves the attached change order in the amount of $1,203.00 to be appropriated from account 75204.1.0.0; and

BE IT RESOLVED, that the Marion Town Board authorizes the transfer of $1,203.00 from unappropriated fund balance to 75204.1.0.0; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Knataitis, the Code Enforcement Officer, and the Account/Audit Clerk.

RESOLUTION 040916
ACCEPT BID AND AUTHORIZE PURCHASE OF USED SWEEPER
On a motion by Councilman Bliek and seconded by Councilman Lonneville, the following resolution was
ADOPTED: Ayes: 5 Bliek, Fonte, Kauffman, Lonneville, Deyo
Nays: 0

WHEREAS, the Marion Town Board authorized the Highway Superintendent to advertise for bids for a used sweeper, per resolution #10 on 03/14/2016; and

WHEREAS, one bid was received and opened on 04/05/2016; now

BE IT RESOLVED, that the Marion Town accepts the bid received from J & J Equipment in the amount of $43,200.00; and

BE IT RESOLVED, that the Marion Town Board authorizes the Highway Superintendent to purchase the used sweeper from J & J Equipment in the amount of $43,200.00 to be appropriated from account 51302.3.0.133; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to J & J Equipment, Highway Superintendent, and the Account/Audit Clerk.

RESOLUTION 041116
AUTHORIZE CODE ENFORCEMENT OFFICER TO PROCEED WITH INJUNCTION AGAINST 4047 MAPLE AVENUE

On a motion by Councilman Lonneville and seconded by Councilman Fonte, the following resolution was
ADOPTED: Ayes: 5 Bliek, Fonte, Kauffman, Lonneville, Deyo
Nays: 0

BE IT RESOLVED, that the Marion Town Board authorizes the Code Enforcement Officer to proceed with an injunction against resident of 4047 Maple Ave; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Town Attorney, and Code Enforcement Officer.

Supervisor Deyo recessed the meeting at 8:27pm for the Board to review the claims. The meeting reconvened at 8:39pm.

PAYMENT OF CLAIMS
On a motion by Councilman Kauffman and seconded by Councilman Lonneville, the following resolution was

WHEREAS, the Marion Town Board has received and audited the following claims; now
BE IT RESOLVED, that the Supervisor is hereby authorized to pay said claims upon receipt of the signed abstracts of audited claims from the Town Clerk.
