MARION ZONING BOARD OF APPEALS MINUTES

May 30, 2017

Time:  7:03pm.  Gregg Bell called the meeting to order.

Present:  Gregg Bell; John Lonneville, Michael Hershelman, Zachary Bartlett, Daniel Sargent and Andrea Vandergrift

Absent: Martha Rich

Also present: Michael Balch and Randall Balliet

7:04 pm – Gregg Bell announced that the voting members are Gregg Bell, Michael Hershelman, Daniel Sargent, Zachary Bartlett and Andrea Vandergrift

7:05 pm – Gregg asked the board if they were any comments or questions regarding the previous meeting minutes. No comments. Michael Hershelman made a motion to approve the minutes from April 25, 2017. Andrea Vandergrift seconded the motion. All in favor.   None opposed.  Motion carried.

New Business: Gregg Bell stated that there are two items on tonight’s agenda.

7:06pm – The first item is Application A-3-17: Randall Balliet – Requesting an area variance to build a 14×20 pole barn 3’ from the property line to leave enough room between existing garage and proposed pole barn for vehicle access to rear of property at 3376 Sheridan Rd Marion, NY

7:07pm –Andrea Vandergrift made a motion to approve neighbor notification. Zachary Bartlett seconded the motion. All in favor.   None opposed.  Motion carried.

7:08pm – Gregg Bell and the board completed/reviewed Section II of the SEAF which is on file in the applicant’s folder. Gregg Bell stated part III is N/A.

7:09pm – Zachary Bartlett made a motion to approve the SEAF as discussed. Andrea Vandergrift seconded the motion. All in favor.   None opposed.  Motion carried.

7:12pm – Gregg Bell and the board reviewed the Agricultural Data Statement, no significant findings or questions from the board.

7:12pm – Daniel Sargent made a motion to approve the Agriculture Data statement. Michael Hershelman seconded the motion. All in favor.   None opposed.  Motion carried.

7:13pm –Gregg Bell opened the Public Hearing.

7:14pm –Gregg Bell closed the Public Hearing as there were no members of the public present to speak.

7:15pm – Gregg Bell asked the board if they had any additional questions of comments. Dan Sargent asked it the pole barn would be for personal or business use. Mr. Balliet stated it would be personal use only.

7:16pm –Andrea Vandergrift moved to approve the application allowing structure to be 3’ from property line. Dan Sargent seconded the motion.

7:17pm – Gregg Bell asked if there was any other questions or comment from the board. None at this time.

7:18pm – All approved. None opposed. Motion carried Application A-3-17 approved

7:20pm – Gregg Bell made an announcement that the last Marion Visioning meeting will be held at Marion High school on Wednesday 5/31/2017 at 7pm.

7:21pm – The second item is Application A-4-17: Michael Balch – Requesting an area variance to build a 30×40 pole barn in front of the home at 4738 Farnsworth Rd Marion, NY

7:22pm – Gregg Bell asked Michael Balch to explain the project: Mr. Balch stated her would like to put up a 30×40 pole barn with a 10ft handover in front of his home due to septic system behind home. Will be 20’ in front of home.

7:25pm –Michael Hershelman made a motion to approve neighbor notification. Zachary Bartlett seconded the motion. All in favor.   None opposed.  Motion carried.

7:26pm – Gregg Bell and the board completed/reviewed Section II of the SEAF which is on file in the applicant’s folder. Gregg Bell stated part III is N/A.

7:29pm – Andrea Vandergrift made a motion to approve the SEAF as discussed. Daniel Sargent seconded the motion. All in favor.   None opposed.  Motion carried.

7:30pm –Gregg Bell and the board reviewed the Agriculture Data Statement form, no significant findings or questions from the board.

7:31pm – Daniel Sargent made a motion to approve the Agriculture Data statement as revised-application for area variance. Zachary Bartlett seconded the motion. All in favor.   None opposed.  Motion carried.

7:31pm –Gregg Bell opened the Public Hearing.

7:32pm –Gregg Bell closed the Public Hearing as there were no members of the public present to speak.

7:33pm – Gregg Bell asked the board if they had any additional questions of comment. Michael Hershelman would like to clarify that the structure would be 15’ from the home not 30’ as originally proposed in the application. Michael Balch stated he would like to get the variance for 20’ in front of the home. Dan Sargent asked if there was also a side variance issue. Mr. Balch stated no. Dan Sargent asked it the pole barn would be for personal or business use. Mr. Balch stated it would be personal use only.

7:38pm –Michael Hershelman moved to approve the application allowing structure to be no more than 20 feet in front of the existing house. Zachary Bartlett seconded the motion.

7:39pm – Gregg Bell asked if there was any other questions or comment from the board. None at this time.

7:40pm – All approved. None opposed. Motion carried Application A-4-17 approved

7:43pm – Old Business: Gregg Bell made the Board aware the next Visioning Meeting date is Wednesday May 30, 2017 at the HS

7:44pm – No other old business

7:46 pm – Zachary Bartlett moved to adjourn the meeting. Michael Hershelman seconded.  Meeting adjourned
