MARION ZONING BOARD OF APPEALS MINUTES
July 26, 2016

Time: 7:04pm. Martha Rich called the meeting to order.

Present: Martha Rich; Gregg Bell; John Lonneville, and Jack Guinan
Absent: Andrea Vandergrift; Kim Pezza; and Nora Craft

Also present: Michael Balch and John Paige

7:12 pm – Martha asked the board if they were any comments or questions regarding the previous meeting minutes. No comments.

Gregg Bell made a motion to approve the minutes from June 28, 2016. Martha Rich seconded the motion. All in favor. None opposed. Meeting minutes approved.

New Business: Martha Rich stated that there are two items on tonight’s agenda.

7:13pm – The first item is Application A-6-16: Area Variance– John Paige, Build Pole Barn, requesting to place building closer to road than house is.. Martha Rich read through the application and determined the neighbor notifications have been signed. She noted the legal notice, agricultural data statement, map and application is in the folder.

7:15pm –Martha Rich asked John Paige to explain his project. Mr. Paige stated he wanted the Pole Barn to keep his farm machinery in so they were not heavily affected by weather. He cannot extend the existing garage or put the pole barn behind his house because the grade of the property will cause it to get to wet.

7:16pm –Martha Rich opened and closed the Public Hearing as there were no members of the public present to speak.

7:17pm – Martha Rich asked if there was any other questions or comment from the board. Jack Guinan asked Mr. Paige to show the board the existing location of where the pole barn would be on the map. The Board is ok with the location.
Gregg Bell asked Mr. Paige if the house to the south of the property also has a barn in front of the property. Mr. Paige stated that is correct and that is what he is also hoping to do. Gregg Bell stated he doesn’t see an issue especially because the house to the south has already been approved for this.

7:17pm – Martha Rich and the board completed the impact assessment section of the application which is on file in the applicants folder.

7:19pm – Martha Rich and the board reviewed the five criteria for an area variance listed in section 602.2 of the ordinances. The answers to the questions are as follows:
a) Yes b) Yes c)No within our scope d) Yes e) No

7:23pm –Gregg Bell moved to approve the pole barn can be placed in front of the house remaining at least 50’ from the road. Jack Guinan seconded the motion. All approved. None opposed. Motion carried Application A-6-16 approved.

7:25pm – The first item is Application A-5-16: Area Variance– Michael Balch, relief of a side setback of 12.1’ to an existing garage where the required setback is difference from the peak to the average grade. Martha Rich read through the application and determined the neighbor notifications have been signed. She noted a letter from the Planning Board recommending approval, the legal notice, agricultural data statement, map and application is in the folder.

7:26pm –Martha Rich asked Michael Balch to explain his project Mr. Balch explained his mother in law passed away and per her will they are subdividing the property. The property line listed in the will is to close to a barn on the property that is why he is requesting an area variance.
Mr. Balch showed the Board the property line on the map and stated if the line was moved over to accommodate the space the garage needed to be from the line he would lose a portion of his driveway.

7:28pm –Gregg Bell asked Mr. Balch the height of the garage. Mr. Balch stated the garage goes from 12’ to 16’.

7:31pm –Martha Rich opened and closed the Public Hearing as there were no members of the public present to speak.

7:34pm – Martha Rich asked if there was any other questions or comment from the board. None at this time.

7:34pm – Martha Rich and the board completed the impact assessment section of the application which is on file in the applicants folder.

7:35pm – Martha Rich and the board reviewed the five criteria for an area variance listed in section 602.2 of the ordinances. The answers to the questions are as follows:
a) Yes b) Yes c)No d) Yes e) No

7:36pm –John Lonneville moved the variance of the side setback of 12.1’. Martha Rich seconded the motion. All approved. None opposed. Motion carried Application A-5-16 approved

7:38pm – Martha Rich asked if there was any additional business, old or new. No new business. No old business.

7:44 pm – Martha Rich moved to adjourn the meeting. John Lonneville seconded. Meeting adjourned
