A regular meeting of the Town Board of the Town of Marion, Wayne County, NY was held on Monday, August 14, 2017 in the Marion Municipal Room.

Supervisor Deyo called the meeting to order at 7:07pm

Nick Deming, Joan Fisher, Ray Seppeler and Heidi Jensen, residents.

Councilman Michael Fonte led us in the Pledge of Allegiance.

TOWN BUSINESS: Councilman Lonneville thanked Monica Deyo, Jeff Cragg, Virginia Mayville, Duane Smeatin and Caryn Devlin for coordinating the work that the Mormon volunteers did. We will be compiling a list throughout the year for next year. He also thanked Monica, Kathy, Virginia, Amy D’Angelo and the business owners in the community for participating in the preparation for the NYS Main Street Grant. We met the submission date of July 28 in the amount of $334,755. Last week we submitted the NYS home and community renewal form. We are hoping to hear in December when the application might be approved. He thanked Tim and the Highway crew for getting the caps on the concrete wall in the municipal parking lot. All that is left there is to put up the guardrail. He also thanked Duane for following up with Brandon Martin on the steel plate on the sidewalk in front of the restaurant. That has been taken care of. Councilman Lonneville stated Tom Salviski is going out for architectural engineering bids for the Restore NY project. We probably won’t start construction work until next spring. He stated he and Nick Deming attended the Wayne County Board of Supervisor’s meeting at the Wayne County Fair. He stated he now knows why he won’t run for Supervisor and thanked Monica and Nick for doing that.

COMMITTEE REPORTS:

Monica Deyo: Water, Sewer, Town Clerk: Regarding Sewer, Jeff Cragg stated he will be attending a regional meeting on August 23. He stated the study is done and a draft will be sent out to see about funding for the regional wastewater project. He is waiting for quotes for repairs on the pump station on Sunset Drive. Debbie Smith, Town Clerk, stated the sale of the E-Z passes is going well. She stated they are also busy with dog licenses and closing out the dog census. They will be sending a second notice to residents who have not responded to the census.

Mike Fonte: Public Safety, Judicial, Library: Councilman Fonte stated he has nothing new. Regarding Public Safety, Councilman Lonneville thanked Mike Fonte for gathering information from other Towns and Debbie Smith and Duane Smeatin for consolidating the paperwork for the nuisance laws. It will be submitted to our Attorney for review and we will schedule a Public Hearing September 11, 2017.

Nathan Kauffman: Parks, Recreation, Assessor: Councilman Kauffman stated the soccer season has ended. It was a success this year. He also stated he has spoken with someone who wants to donate some soccer equipment or money towards equipment. He will be meeting with Virginia Mayville this week to get new updates to our website launched. Nothing for Assessor.

Historian, Planning and Zoning: Councilman Lonneville thanked former resident, Barry Thorne, for donating historic books on Wayne County. Tim Leno is working on the electric at Jennie’s House. Most of the 1st floor has been completed. Duane Smeatin is working on the plumbing, sinks and toilet, tub and other carpentry work to move the project along. Duane and John Lonneville met regarding the surveillance. Caryn Devlin and the Historic Association are looking for fund raising ideas. We need to check with Art Williams, Town Attorney regarding how we can go out for funding and who can do the funding as the Town owns the building and the Historic Association is separate. Councilman Lonneville is not confident we will be getting the money from Senator Nozzolio/Helming and stated he will be looking at other options. Regarding Planning and Zoning, there is a meeting on Wednesday of the Comprehensive team looking at a survey to go out to all residents. He will be doing some brainstorming with the team and Amy D’Angelo.

LaVerne Bliek: Highway, Drainage: Wayne County will be doing work on the drainage on Mill Street next year. The Wayne County Water and Sewer Authority will put in new waterlines from 3655 Mill Street to Smith Road (possibly to Main Street). The Town will pay for the pipes and the Water Authority will install them. He stated the Highway helped the county with trucking, weed whacked around some signs, oiled and stoned, repaired some lawn damage on South Main Street, put the caps on the wall of the municipal parking lot, cleaned the shop and serviced equipment.
Councilman Bliek also stated there is a Drainage Committee meeting on Wednesday at 3pm.

ADJUST NUMBER OF SEWER UNITS FOR GLM EQUITIES LLC

On a motion by Councilman Bliek and seconded by Councilman Lonneville,
the following resolution was

WHEREAS, the Town of Marion has received notification from Robert Kase, GLM Equities LLC, that property number 65114-00-637719 has begun a temporary occupancy use of 45 people from July 24, 2017 thru “approximately” November 30, 2017; and

WHEREAS, Robert Kase must notify the Town of Marion in writing when the “actual” occupancy changes from 45 people; now

BE IT RESOLVED, that the Marion Town Board authorizes the change in unit charges for the Property of GLM Equities LLC, number 65114-00-637719 from one unit to 7 units effective July 24, 2017 thru “approximately” November 30, 2017; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Robert Kase of GLM Equities LLC, Wayne County Water and Sewer Authority, Chief Operator WWTP, and the Town Assessor.

BE IT RESOLVED, that the Marion Town Board authorizes hiring Joe Manders to fill the vacancy on the Board of Assessment Review for a term of 10/1/17-9/30/22; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Joe Manders, Tina McQuillen, and the Principal Account Clerk.

AND BE IT RESOLVED that the Town Board of the Town of Marion will hold a Public Hearing to amend the Property Nuisance Local Law on September 11, 2017 @ 7:00 at the Marion Municipal Room, 3825 N. Main Street, Marion, New York, at which time and place any persons may be heard in favor or against any items therein contained; and

AND BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Duane Smeatin, Code Officer.

Supervisor Deyo recessed the meeting at 7:45pm to go into executive session to discuss the employment benefit of a particular employee. The meeting reconvened at 8:25pm.

RESOLUTION 080717
AUTHORIZE THE PRINCIPAL ACCOUNT CLERK, KATHLEEN CAUWELS, TO TAKE A PAID VACATION FROM AUGUST 14, 2017 – AUGUST 18, 2017 WITH THE STIPULATION THAT SHE RETURN ON WEDNESDAY, AUGUST 16, 2017 TO PROCESS PAYROLL AND ACCOUNTS PAYABLE CHECKS

On a motion by Councilman Kauffman and seconded by Councilman Lonneville, the following resolution was

BE IT RESOLVED, that the Marion Town Board authorizes the Principal Account Clerk to take a paid vacation from August 14, 2017 – August 18, 2017, a one-time hiring benefit as offered.

AND BE IT RESOLVED that the Principal Account Clerk will return to the office on Wednesday August 16, 2017 to process payroll and to complete the Accounts Payable for August 14, 2017, and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.
Supervisor Deyo recessed the meeting for the Board to review the claims at 8:26pm. The meeting reconvened at 4:46pm.

On a motion by Councilman Fonte and seconded by Councilman Kauffman, the following resolution was

WHEREAS, the Marion Town Board has received and audited the following claims; now
BE IT RESOLVED, that the Supervisor is hereby authorized to pay said claims upon receipt of the signed abstracts of audited claims from the Town Clerk.
