A regular meeting of the Town Board of the Town of Marion, Wayne County, NY was held on Monday, July 10, 2017 in the Marion Municipal Room.

Supervisor Deyo called the meeting to order at 7:02pm

ABSENT:

OTHERS IN ATTENDANCE: Perry Howland, Sun & Record; Becky Block, The Times of Wayne County; Duane Smeatin, Code Enforcement Officer; Jeff Cragg, Waste Water Treatment Plant Operator; Tim Boerman, Highway Superintendent; Nick Deming, Joan Fisher and Ray Seppeler, residents.

Councilman Michael Fonte led us in the Pledge of Allegiance.

TOWN BUSINESS: Councilman Lonneville thanked Tim Boerman and the Highway Department for paving/striping the parking lot and to Williamson, Walworth and Ontario for providing truck support. It certainly makes Main Street more presentable and provides much needed space for off street parking.
Councilman Lonneville thanked Virginia and Jeff for repairing and repainting the Business District sign.
Councilman Fonte stated there was a vehicle parked on Main Street for over 2 ½ weeks. Duane Smeatin, Code Enforcement Office, sent a letter and the car is gone now. He stated there is nothing on the books or on the street that designates how long we can park on the street and no overnight parking. Supervisor Deyo stated there are signs that designate 2 hour parking. Councilman Lonneville stated it is confusing – does the sign state only at the
sign or is it the whole street. He stated we need to make it clearer. Councilman Fonte suggested there should be a sign at each end with arrows. He stated designating spaces in the parking lot for employees or by permit. Councilman
Lonneville stated we should talk about it at a workshop. Supervisor Deyo stated the problem is going to be enforcement.
Councilman Kauffman stated he is talking with a developer who is looking for properties for Assisted Living. He suggested bringing him into a workshop. Councilman Kauffman will send them an email. Councilman Kauffman stated Adam Casper would like to come in and talk with the Board. Supervisor Deyo stated she would like to see Adam’s proposal and she will ask Nationwide to do the same. It was suggested Adam come into a workshop.
Councilman Fonte stated that the benches around the perimeter of the park are in need of staining. Tim Boerman, Highway Superintendent, stated they will take care of it this winter.

CITIZEN’S COMMENTS: Perry Howland, reporter for the Sun and Record, asked about the Mural. Councilman Lonneville stated it is being repainted. Supervisor Deyo stated she will be the original contract for the Board for the next workshop.

COMMITTEE REPORTS:

Monica Deyo: Water, Sewer, Town Clerk: Supervisor Deyo stated the dog enumeration is going well. They licensed 78 new dogs to date along with 153 renewals. She also stated the Town Clerk’s office is selling Booster tickets for the Wayne County Fair August 14 through the 19.
Supervisor Deyo stated we are moving along with the plans for funding for the regional WWTP with the Town of Marion, the Town of Macedon and the Village of Palmyra and operated by the Wayne County Water and Sewer Authority. There are ongoing talks between Marion and Sodus, Williamson, Arcadia, Huron, Lyons, and the Wayne County Water and Sewer Authority for an additional water storage tank.

Mike Fonte: Public Safety, Judicial, Library: Councilman Fonte stated he has received information from Tracy Whitney, Library Director, regarding summer programs from July 5 – August 8. Nothing new to report for Judicial. Regarding Public Safety, Councilman Fonte stated hopefully by the end of the month the steel plate on the sidewalk in front of the restaurant will be taken care of. He also stated the striping on North Main Street is getting faded. Tim Boerman stated he thought they would do it again this summer.

Nathan Kauffman: Parks, Recreation, Assessor: Councilman Kauffman had nothing new to report on the Assessor. He stated we need a resolution to go ahead with the park’s grant. The cost is $250.00. They will send us additional information along with a questionnaire. There are also additional upcoming grants. Supervisor Deyo asked for references as this is a new company to us.

Historian, Planning and Zoning: Councilman Lonneville stated we are looking to continue with the electric this week at Jennie’s House. The Comp team is working on putting together a survey to get out to the community so we can get some more input for our visioning process. He is working with Amy D’Angelo and Tom Salviski on the Restore NY grant. He is also working with Amy and the business owners on Main Street to pursue a NYS Main Street program.

LaVerne Bliek: Highway, Drainage: Regarding drainage, Tim Boerman stated we need to finish the drainage on North Main. Regarding the drainage problem on Mill Street, Tim spoke with the county and next summer they are redoing the gutters from Pembroke to So. Main. There are a couple more little drainage projects for this year.
Tim thanked the Towns of Williamson, Ontario and Walworth for their help with the parking lot. He also thanked the County for their help doing the shoulders on Reeves Road, after which it was oiled and stoned.
The Highway crew also hauled stone, serviced trucks, did maintenance in the shop, mowed the park, Jennie’s House, Library and roadsides.

AUTHORIZE HIGHWAY SUPERINTENDENT TO ATTEND 88TH ANNUAL NEW YORK STATE ASSOCIATION OF TOWN SUPERINTENDENTS OF HIGHWAYS CONFERENCE

BE IT RESOLVED, that the Marion Town Board authorizes Timothy Boerman, Highway Superintendent, to attend the 88th Annual New York State Association of Superintendents of Highways Conference and Education Symposium to be conducted at the Holiday Valley Resort 6557 Holiday Valley Road Ellicottville,N.Y.14731 Tuesday, September 19, 2017 through Friday, September 22, 2017, and

BE IT RESOLVED, that expenses incurred for registration, travel, lodging and meals be paid by the Town of Marion from Account #50104.1.0.16 at a cost not to exceed budgeted amount, and

BE IT RESOLVED, that the Marion Town Board regretfully accepts the resignation of William VanDeWeghe effective June 13, 2017; and

BE IT RESOLVED, the Marion Town Board Authorizes the Town Clerk to advertise to fill the position, and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to William VanDeWeghe, Angela Patterson, and the Principal Account Clerk.

On a motion by Councilman Bliek and seconded by Councilman Lonneville, the following resolution was duly put to a vote which resulted in the following:

WHEREAS, Theresa Keyser has submitted her resignation as Custodian effective July 7, 2017; now

BE IT RESOLVED, that the Marion Town Board regretfully accepts the resignation of Theresa Keyser effective July 7, 2017; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Theresa Keyser and the Principal Account Clerk.

AMEND RESOLUTION #6 – 06/12/17 Meeting – AUTHORIZE PROPOSED AGREEMENT WITH STERLING PLANNING SERVICES

On a motion by Councilman Lonneville and seconded by Councilman Bliek, the following resolution was
ADOPTED: Ayes: 5 Bliek, Fonte, Kauffman, Lonneville, Deyo

BE IT RESOLVED, that the Marion Town Board authorizes the proposed agreement with Sterling Planning Services to assist with the Restore NY Grant for an amount not to exceed $700 for 2017 to be appropriated from account #A80204.01.000.208, and

AND BE IT RESOLVED, that the Marion Town Board authorized the transfer of $700 from contingency account #19904.1.0.000 and put into account 80204.01.000.208 Restore NY, and

BE IT RESOLVED, that the Marion Town Board authorizes the proposed agreement with Sterling Planning Services to assist with the Town of Marion Comprehensive Plan for an amount not to exceed $1800 for 2017 to be appropriated from account #80204.01.000.207, and

AND BE IT RESOLVED, that the Marion Town Board authorizes the transfer of $1800 from contingency account #19904.1.0.000 and put into account 80204.01.000.208 Comprehensive Plan, and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Amy D’Angelo, and the Principal Account Clerk.

On a motion by Councilman Kauffman and seconded by Councilman Lonneville, the following resolution was

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the proposed agreement with Sterling Planning Services to administer the New York Main Street Program for an amount not to exceed $2600 for 2017 to be appropriated from account #80204.01.000.206, and

AND BE IT RESOLVED, that the Marion Town Board authorizes the transfer of $2600.00 from contingency account #19904.1.0.000 and put into account 80204.01.000.206 NYS Main Street Program and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Amy D’Angelo and the Principal Account Clerk.

AUTHORIZE SUPERVISOR TO SIGN MEMO OF UNDERSTANDING – REGIONAL WASTEWATER PROJECT

On a motion by Councilman Bliek and seconded by Councilman Fonte, the following resolution was

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign Memo of Understanding in support of Regional Wastewater Project, and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Wayne County Water and Sewer Authority, Chief Operator of Marion’s WWTP, and the Principal Account Clerk.
Supervisor Deyo recessed the meeting for the Board to review the claims at 8:33pm. The meeting reconvened at 9:04pm.

BE IT RESOLVED, that the Supervisor is hereby authorized to pay said claims upon receipt of the signed abstracts of audited claims from the Town Clerk.
