TOWN BOARD MEETING
Marion Municipal Room
March 13, 2017


A regular meeting of the Town Board of the Town of Marion, Wayne County, NY was held on Monday, March 13, 2017 in the Marion Municipal Room.

Supervisor Deyo called the meeting to order at 7:15pm. She welcomed the guests and encouraged them to ask questions.

OTHERS IN ATTENDANCE: Perry Howland, Sun & Record; Tim Boerman, Highway Superintendent; Jeff Cragg, WWTP Operator; Virginia Mayville, WWTPO; Duane Smeatin, Code Enforcement Officer, Michael Sayers, Michelle Fioco, Nick and Carrie Deming, residents and four par-gov students.

Supervisor Deyo lead us in the Pledge of Allegiance.

Supervisor Deyo welcomed the guests and encouraged them to ask questions.

TOWN BUSINESS:

CITIZEN’S COMMENTS: Michael Sayers, 4241 White Road asked why the letter denying his request to have the water district debt service removed from his taxes was different from what occurred at the previous meeting. Supervisor Deyo stated the Board talked to Tina McQuillen, Town Assessor, and she said it should be an improved lot. He claims it is not improved, not a typical home (no heat, no plumbing, no water). The Town Board will review it with the Assessor and Real Property Tax

COMMITTEE REPORTS:

Monica Deyo: Water, Sewer, Town Clerk: Regarding Sewer, Jeff Cragg stated he is waiting for the results of his proficiency tests done in February.
Debbie Smith, Town Clerk/Tax Collector, reported her office has collected $3,129,392.67 to date. Total to date left unpaid is $388,943.75.

Mike Fonte: Public Safety, Judicial, Library: Absent

Nathan Kauffman: Parks, Recreation, Assessor: Councilman Kauffman reported that baseball registration was completed Sunday night. He is still investigating grants from NYS Parks and Recreation and private foundations. These would include playgrounds and building improvements. They specialize in grants under $100,000.00. He also stated he will be meeting with Candice Loveless, Baseball Supervisor to take stock of equipment. Jeff Cragg stated he has PVC sections at the Waste Water Treatment Plant if they need them for soccer goals. Supervisor Deyo stated Slices Pizza will be doing the concessions this year.

Ron Lonneville: Historian, Zoning, Planning: Councilman Lonneville stated Caryn Devlin, Town Historian, will be attending a conference April 6 – 9. He stated the Town is updating our Comprehensive Plan and we are involving the community. Residents are invited to attend the meetings March 27, April 11, April 24 and May 16. Amy D’Angelo of the Wayne County Economic and Planning Development will facilitate the meetings.
He stated all bids are in for Jennie’s House. Resolutions to follow for these and also to appoint two new Zoning Board members and a Board of Assessment Review member.

LaVerne Bliek: Highway, Drainage: Councilman Bliek stated there will be a Drainage meeting at 3pm, weather permitting.
Tim Boerman, Highway Superintendent, stated they plowed 19 times, chopped brush on roadside, mixed sand and salt, repaired and did maintenance on vehicles. A resident asked how he determines when to send plows out. He
stated it was by his judgement and prioritizes during school times.

Valor Linke, a Marion student, asked the Board to consider putting a skate park in Marion. He will bring in pics of what he would like.

The Town of Marion is accepting applications for the position of Soccer Supervisor for the 2017 Soccer Season. Applications may be picked up at the Marion Town Clerk’s Office and returned there by March 27, 2017. Any questions may be directed to the Supervisor @ (315) 926-4145

AUTHORIZE ATTENDANCE AT THE ANNUAL NYS TOWN CLERK’S ASSOCIATION CONFERENCE

On a motion by Councilman Bliek and seconded by Councilman Lonneville, the following resolution was

BE IT RESOLVED, that the Marion Town Board authorizes Deborah Smith, Town Clerk, to attend the Annual NYS Association of Towns Annual Town Clerk meeting on April 23 – April 26, 2007 in Rochester, NY at a cost not to exceed $1,200.00; and

BE IT RESOLVED, that lodging, travel and registration expenses shall be paid from Account 1410.1.0.016, and

BE IT FURTHER RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Town Clerk and Principal Account Clerk.

On a motion by Councilman Lonneville and seconded by Councilman Bliek, the following resolution was

BE IT RESOLVED, that the Marion Town Board authorizes the transfer of $28253.40 from RD830.230; and

BE IT RESOLVED, that the Marion Town Board amends the 2017 budget as follows:
Increase 12201.01.021 Account Clerk Salary $28253.40

Increase 5031.1 Interfund Transfers $28253.40

BE IT FURTHER RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

AUTHORIZE SUPERVISOR TO SIGN AGREEMENT WITH SBA

On a motion by Councilman Bliek and seconded by Councilman Lonneville, the following resolution was

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the attached agreement with SBA, and

AUTHORIZE AGREEMENT TO SPEND TOWN HIGHWAY FUNDS

On a motion by Councilman Bliek and seconded by Councilman Lonneville, the following resolution was

WHEREAS, Tim Boerman, Highway Superintendent, has prepared an agreement to spend Town Highway Funds for 2017 as attached; now

BE IT RESOLVED, that the Marion Town Board accepts and approves said agreement and authorizes all members of the Town Board and Town Highway Superintendent to sign said agreement in duplicate and forward to the County Superintendent of Highway for his signature; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Highway Superintendent and the Principal Account Clerk.

AUTHORIZE CARYN DEVLIN, HISTORIAN. TO ATTEND PRESERVATION NY CONFERENCE

On a motion by Councilman Lonneville and seconded by Councilman Bliek, the following resolution was

BE IT RESOLVED, that the Marion Town Board authorizes Caryn Devlin, Historian, to attend the Preservation NY Conference in Rochester, NY from April 6-9 at a cost of $89, travel and food expenses are to be reimbursed by the Town; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Historian and Principal Account Clerk.

Electric upgrades not to exceed $15,180 to be expended out of 75204.1.000, and

BE IT FURTHER RESOLVED directs the Clerk of the Board to give a copy of this resolution to the Code Enforcement Officer, Ronald Lonneville and Principal Account Clerk.

HVAC Upgrades not to exceed $8,900 to be expended out of 75204.1.000

BE IT FURTHER RESOLVED directs the Clerk of the Board to give a copy of this resolution to John Cornell, the Code Enforcement Officer, Ronald Lonneville and Principal Account Clerk.

Supervisor Deyo recessed the meeting for the Board to review the claims and audit the books at 8:38pm. The meeting reconvened at 8:55pm.
